RESOLUTION NO. 2244 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING SEALED PROPOSAL AND AWARDING CONTRACT TO THE LOWEST RE- SPONSIBLE BIDDER FOR THE FURNISHING TO THE CITY OF ANAHEIM OF CAST IRON WATER PIPE AND FITTINGS. WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circula- tion, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on the 28th day of August, 1953 and the 3rd day of September, 1953, a notice inviting sealed proposals for the furnishing to the City of Anaheim, in approximate quantities, the following cast iron water pipe and fittings: 7,000 feet of 12 inch cast iron pipe. 4,000 feet of 10 inch cast iron pipe. 25,000 feet of 6 inch cast iron pipe. 10,000 feet of 4 inch cast iron pipe. 25,000 pounds of cast iron fittings, WHEREAS, said notice did provide that said pipe and fittings shall be in accordance with and conform to "Specifications for Cast Iron Water Pipe, Series of 1953, City of Anaheim and WUEREAS, such notice inviting proposals for said cast iron water pipe and fittings did provide that said sealed proposals would be received by the City Council of the City of Anaheim at the office of the City Clerk of said City up to the hour of 8:00 o'clock P.M. of Tuesday, the 8th day of September, 1953 for the furnishing to said City of said water pipe and fittings; and WHEREAS, the City Clerk of the City of Anaheim did receive sealed proposals prior to 8:00 P. CLOW SONS I (18 Lgth.) $21,140.00 II It 9,560.00 III 31,750.00 IV 8,700.00 3,250.00 TOTAL AMOUNT OF PROPOSAL $74,400.00 Freight allowance to Anaheim 22,005.00 Total. .$96,405.00 WHEREAS, the City Council did thereupon submit all bids received to the Superintendent of Power and Light of the City of Anaheim for tabulation and report to the City Council, and said Superintendent of Power and Light having tabulated said bids and having submitted his report, the City Council does find that the sealed proposal of the PACIFIC STATES CAST IRON PIPE CO., 6399 Wilshire Boulevard, Room 401, Los Angeles 48, California is the lowest responsible bid for the furnish- ing of cast iron water pipe and fittings specified in Items I, II, III, IV and V of the notice inviting sealed proposals and in accordance with the specifications set forth in said notice inviting sealed proposals, and that said proposal of the Pacific States Cast Iron Pipe Oo. should be accepted and a contract awarded to said company for furnishing said pipe and fittings to the City of Anaheim; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said proposal submitted by the Pacific States Oast Iron Pipe Co. for the furnishing of cast iron water pipe and fittings, as specified in the notice in- viting sealed proposals therefor and in accordance with and conformity to "Specifications for Oast Iron Water Pipe, Series of 1953, City of Anaheim," be, and the same is hereby, ac- cepted and that a contract for the furnishing of said water pipe and fittings be, and the same is hereby, awarded to said Pacific States Cast Iron Pipe Co.; and BE IT FURTHER RESOLVED that the award of a contract to said Pacific States Oast Iron Pipe Co. is declared to be for the approximate quantities set forth in the notice inviting sealed proposals; and -2- TOTAL PRICE BE IT FURTHER RESOLVED that said Pacific States Oast Iron Pipe Co. be, and they are hereby, required to execute a contract, in required form satisfactory to the City of Anaheim and upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by it, and in accordance with the specifications for cast iron water pipe and fittings as set forth in said notice inviting sealed proposals for the furnishing of said cast iron water pipe and fittings hereinabove more par- ticularly set forth and specified,in all required lengths, at the prices as follow: ITEM PRICE PER FT. PRICE I 7,000 ft. of 12 inch cast iron pipe $3.3555 $23,488.50 II 4,000 ft. of 10 inch cast iron pipe $2.6496 10,598.40 III 25,000 ft. of 6 inch cast iron pipe $1.3631 34,077.50 IV 10,000 ft. of 4 inch cast iron pipe $0.9254 9,254.00 V 25,000 lbs. of cast iron PER LB. fittings x$0.134 3,350.00 $80,768.40 Freight allowance to Anaheim 9,459.40 $70,227.80 and BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that said bid be, and the same is hereby, ac- cepted and said contract awarded for the above prices for said cast iron pipe and fittings, F.0.B. the mill with freight allowance to Anaheim; said pipe and fittings to be delivered as required by the City of Anaheim; and BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, author- ized and directed to execute for and on behalf of the City of Anaheim with said Pacific States Cast Iron Pipe Co. a written contract for the furnishing of said cast iron water pipe and fittings hereinabove set forth and in accordance with the specifications for cast iron water pipe, Series of 1953, City of Anaheim, the notice inviting sealed proposals and the terms of this resolution, and the contract approved by the City Attorney of the City of Anaheim; and BE IT FURTHER RESOLVED that said contract shall con- tain a provision that should said Pacific States Oast Iron Pipe Co. fail or neglect to furnish said cast iron pipe and /or fittings in accordance with said specifications and the sealed proposal submitted by it and accepted by the City as herein specified, they shall, in addition to any other penalties pro- vided in the contract document, be liable to the City of Anaheim for all loss or damage that the latter may suffer on account thereof. -3- THE FOREGOING RESOLUTION is approved and signed by me this 22nd day of September, 1953.
