A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
AND ACQUISITION OF CERTAIN REAL PROPERTY
FOR PUBLIC PURPOSES.
WHEREAS, R. N. LAGERLOF and VIRGINIA S. LAGERLOF,
husband and wife, and CLIFF L. EVEID4AN and ESTA K. EVERMAN,
husband and wife, are the owners of the hereinafter desoribed
real property; and
WHEREAS, said owners have offered to sell said pro-
perty to the City of Anaheim for the sum of #4,000.00 cash,
lawful money of the United States; and
WHEREAS, the City Council does find and determine that
public convenienoe and necessity require the purchase and ac-
quisition of said parcel of real property for public purposes
and that the price which the owners thereof are willing to ac-
cept is reasonable and not out of proportion to the fair mar-
ket value of said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of R. N. LAGERLOF and
VIRGINIA S. LAGERLOF, husband and wife, and CLIFF L. EVERMAN
and ESTA K. EVERV~N, husband and wife, to sell said property
situated in the City of Anaheim, County of Orange and state
of California, described as follows, to wit:
That portion of the northwest quarter of the
southeast quarter of Seotion 17, township 4
South, Range 10 West, in the Ranoho Los Coy-
otes, lying easterly and northeasterly of the
easterly and northeasterly line of Traot No.
2425, as per map recorded in book 74 pages
15 to 18 inclusive of Miscellaneous Maps,
in the office of the oounty reoorder of said
county,
for the sum of $4,000.00 cash, lawful money of the United states,
be, and the same is hereby, aocepted, subject to the following
terms and conditions:
1. That the offsite improvements will be oompleted
in accordanoe with street improvement plans for
Tract No. 2425, and at no expense to the City
of Anaheim.

2. That subject property shall be conveyed to the
City of Anaheim free and clear of all encumbrances
except covenants, conditions, restrictions and
public utility easements of record.
BE IT FURTHER RESOLVED, that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
for and on behalf of the City of Anaheim, to sign escrow in-
structions for the purchase of said real property and to enter
into an escrow with the owners of said property at Title Insu-
rance and Trust Company, Santa Ana, California.

AND BE IT FURTHER RESOLVED that the City Treasurer be,
and she 1s hereby, authorized to deposit in escrow at Title In-
surance and Trust Company, Santa Ana, California, the sum of
$4,000.00 cash, lawful money of the United States, to be paid
to the owners of said real property when a deed oonveying said
property to the City of Anaheim, free and clear of all enoum-
branoes, except as hereinabove set forth, can be reoorded and
a pOlicy of title insurance issued by Title Insuranoe and Trust
Company, Santa Ana, California, showing said property vested
in the City of Anaheim, as hereinabove specified.
AND BE I'I' FURTHER RESOLVED that the sellers shall pay
the usual and customary seller's oharges for furnishing the
policy of title insurance necessary to show title vested in
the City of Anaheim, as herein provided, and that the City of
Anaheim shall pay the usual buyer's share in the purchase of
said property.
THE FOREOOING RESOLUTION is signed and approved by
me this net day of February, 1956. /-
