1953-2210RESOLUTION NO. 2210 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT IT IS NECESSARY TO CREATE A NEW ZONE TO BE KNOWN AS THE P -L, PARKING LANDSCAPING ZONE, IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODS; SHOULD BE AMENDED BY ADDING THERETO A NEW SECTION TO BE NUMBERED 9200.21 TO ACCOMPLISH SAID PURPOSE. WHEREAS, the City Planning Commission of the City of Anaheim did heretofore initiate and conduct hearings and pro- ceedings in the manner required by Article IX, Chapter 2 of the Anaheim Municipal Code for the purpose of considering and determining whether or not a new zone, to be known as the P -L, Parking Landscaping Zone, should be created and estab- lished; and WHEREAS, within a period of forty (40) days following the final hearing thereon the City Planning Commission did duly announce by formal Resolution N 5 Series 1953 -54 its find- ings of fact and declare its opinions and reasons for recom- mending an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to effect the establishment of the new zone to be known as P -L, Parking Landscaping Zone; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission the City Council did thereupon fix the llth day of August, 1953 as the time and the Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed establishment of a new zone to be known as the P -L, Parking Landscaping Zone and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Munioipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportu- nity to be heard and did receive evidence and reports and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the establishment and creation of a new zone to be known as the P -L, Parking- Landscaping Zone will improve the future appearance of the City of Anaheim; that there will be no sharp line of demarcation between residential properties and heavier uses where such zones are established, and that residential areas can be established near zones where heavier uses are permitted without devaluation of property values; and that it would be for the advantage and best interests of the City of Anaheim and the citizens and residents thereof that the establishment of such zone or zones be authorized. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the establishment of such zone or zones be authorized by the amendment of Article IX, Chapter 2 of the Anaheim Municipal Code by the addition of a new section thereto numbered 9200.21 reading as follows: -1- SECTION 9200.21 "P -L," Parking Landscaping Zone. A. USE 1. This zone will be used in connection with newly established: a. HC -1 Neighborhood Commercial Zones. b. 0 0 -2 General Commercial Zones. c. 0 M -1 Light Manufacturing Zones. d. 0 M -2 Heavy Manufacturing Zones. This zone shall be reserved for parking of automobiles and landscaping. 2. No buildings shall be erected in this zone except an entrance or watchman's shelter. 3. The minimum depth that shall be reserved for landscaping shall be twenty -five (25) feet. a. This area shall be planted with lawn and /or flowers, and shall be planted by the owner with suitable trees set at intervals not greater than 25 feet. b. The rear four (4) feet of the landscap- ing area may be used for hedges at the option of the owner. The types of trees and hedges to be planted shall be specified by the Anaheim Superintendent of Parks. c. There shall be an entrance and exit driveway into the parking area. There may be separate driveways or a combi- nation entrance and exit driveway, with a minimum of twelve (12) feet for each line of travel. 4. The minimum depth to be reserved for Parking shall be thirty -five (35) feet which will allow sixteen and one -half (164) feet for parking a single line of automobiles, and eighteen and one -half (182) feet for a driveway. The maximum depth for parking in front of the building shall be limited only by the size of the property or lot. 5. In some cases the depth of the parking re- quirements in this zone may be irregular or variable depending upon the particular property involved. 6. In issuing a "USE AND OCCUPANCY PERMIT,“ it shall be specified that the P -L, Parking- Landscaping Zone be developed and maintained as outlined above. -2- and 7. Any person, firm or corporation violating any of these provisions, by not developing the zone as specified and maintaining same, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punish- able by fine of not more than Three Hundred (300.00) Dollars for every 100 feet or less; BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be neces- sary and proper.
