1953-2198RESOLUTION NO. 2198 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING AN OPTION TO THE ANAHEIM ELEMENTARY SCHOOL DISTRICT TO PURCHASE CERTAIN REAL PROPERTY OWNED BY THE CITY OF ANAHEIM. WHEREAS, the City of Anaheim is the owner of all that certain real property hereinafter more particularly described; and WHEREAS, the Anaheim Elementary School District owns certain real property adjoining the property owned by the City of Anaheim and has found and determined that it will be necessary to enlarge the school facilities within the near future, and that more land will be necessary to enable them to do so; and WHEREAS, said Anaheim Elementary School District has requested that they be granted an option to purchase the hereinafter described real property for school purposes; and WHEREAS, the City Council does find and determine that said real property is not immediately required by the City of Anaheim for any necessary public use, and that it would be to the advantage of and for the best interest of the residents and citizens of Anaheim to grant said option to the Anaheim Elementary School District to enable them to adequate- ly provide school facilities for the children residing in that area, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Anaheim Elementary School District be and it is hereby granted an option, for a term of two (2) years, to purchase the following described real property situated in the City of Anaheim, County of Orange, State of California, more particularly described as follows, to -wit: A tract of land in the City of Anaheim, Cali- fornia, being a portion of Lot 18 of Anaheim Extension, as shown on a map thereof made by William Hamel in 1868 and filed in Book 3, Pages 162 164, Records of Los Angeles County, and more particularly described as follows: Beginning at the point of intersection of the center lines of Placentia Avenue and East Vermont Avenue; thence Southwestwardly along the center line of said East Vermont Avenue a distance of 754.52 feet, more or less, to a point, said point being the true point of beginning; thence South, eas twardly at right angles to said center line of East Vermont Avenue a distance of 468.60 feet to a point; thence Southwestwardly along a line parallel to the said center line of East Vermont Avenue a distance of 500 feet to a point; thence Northwest wardiy 82.74 feet, more or less, as measured at right angles to the said center line of East Vermont Avenue to a point; thence Northeastwardly along a line parallel to the said center line of East Vermont Avenue a distance of 318 feet, more /7a ATTEST: or less, to a point; thence Northwestwardly along a line measured at right angles to the said center line of East Vermont Avenue a distance of 385.86 feet, more or less, to a point on the said center line of East Vermont Avenue; thence Northeastwardly along said center line of East Vermont Avenue a distance of 182.00 feet, more or less, to the point of beginning. EXCEPTING therefrom that portion now lying within East Vermont Avenue, for the fair market price of said real property at the time that said option is exercised, which said fair market price shall be ascertained and determined as follows: The City of Anaheim shall select an appraiser and the Anaheim Elementary School District shall select an appraiser, and these two appraisers shall appraise the property and de- termine the fair market value thereof. If they are unable to agree, they shall select a third appraiser and the three appraisers so selected shall determine the fair market value of said property by a majority vote and their determi- nation shall be binding upon the parties hereto; and that the Anaheim Elementary School District shall pay a consider- ation of Ten Dollars 010.00) for said option; and BE IT FURTHER RESOLVED that the Mayor and the City Clerk of'the City of Anaheim be, and they are hereby, authorized and directed to make, execute and deliver an option to the Anaheim Elementary School District to pur- chase the hereinabove described real property upon the terms and 'conditions herein set forth.
