did cause to be published in a newspaper of general circula-
tion, printed, published and circulated in the City of
Anaheim, to wit: The Anaheim Bulletin, on the 29th day of
May 1953 and the 5th day of June ,1953, a
notice inviting sealed proposals for the furnishing to the
City of Anaheim, in approximate quantities, the following
concrete cylinder water pipe and fittings:
Item 1.
14,000 feet 18 I.D. reinforced concrete steel
cylinder pipe, including rubber
gaskets for installation.
and
Item 3.
Six
Item 4.
Twelve 18" flanged connections to 18" gate
valves.
Item 5.
Twenty -five 6" flanged outlets for fire hydrant
connections, including 25 flanges.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING SEALED PROPOSAL
AND AWARDING CONTRACT TO THE LOWEST RE-
SPONSIBLE BIDDER FOR THE FURNISHING TO
THE CITY OF ANAHEIM OF CONCRETE CYLINDER
WATER PIPE AND FITTINGS.

18" x 18" x 12" x 12" I.D. fabricated
crosses, with J.2" branches adapted
for flanged connection, including
12 blank flanges.
18" x 10" fabricated reducer fitting
with 10" end adapted to lay into a
standard 10" cast iron bell joint and
18" end adapted with rubber gasket
joint to lay with 18" cylinder pipe;
WHEREAS, said notice did provide that said pipe and
fittings shall be in accordance with and conform to Federal
Specifications SS -P -0038 of April 2, 1953, and shall be pipe
of Class 150 for 150 lbs. maximum water working pressure; and
WHEREAS, such notice inviting proposals for such
concrete cylinder water pipe and fittings did provide that
said sealed proposals would be received by the City Council
of the City of Anaheim at the office of the City Clerk of the

City of Anaheim up to the hour of 8 :00 o'clock P.M. of Tuesday,
the 9th day of June, 1953 for the furnishing to said City of
said water pipe and fittings; and
WHEREAS, the City Clerk of the City of Anaheim did
receive sealed proposals prior to 8:00 o'clock P.M., Tuesday,
the 9th day of June, 1953 for the furnishing of said concrete
cylinder water pipe and fittings from the following persons,
firms or corporations:

WHEREAS, the City Council did thereupon submit all
bids received to the Superintendent of Power and Light of the
City of the City for tabulation and report to the City Council,
and said Superintendent of Power and Light having tabulated
said bids and having submitted his report, the City Council
does find that the sealed roposal of American Pipe and Con-
struction Co., P. 0. Box 3k28, Terminal Annex, Los Angeles
54, California, is the lowest responsible bid for the furnish,-
ing of concrete cylinder water pipe and fittings specified
in Items 1, 3, 4, 5 and 6 of the notice inviting sealed pro-
posals in accordance with the specifications set forth in
said notice inviting sealed proposals, and that said proposal
of American Pipe and Construction Co. should be accepted and
a contract awarded to said company for furnishing said pipe
and fittings to the City of Anaheim; and
WHEREAS, the City Council does find that all bids
submitted for the furnishing of the concrete cylinder water
pipe specified in Item 2 of the notice inviting sealed proposals
therefor should be rejected;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said proposal submitted by the
American Pipe and Construction Co. for the furnishing of
concrete cylinder water pipe and fittings, as specified in
Items 1, 3, 4, 5 and 6 of the notice inviting sealed pro-
posals therefor, in accordance with the notice inviting
sealed proposals and in accordance with and conformity to
Federal Specifications SS-P-0038 of April 2, 1953, and con-
forming to pipe of Class 150 for 150 lbs. maximum water work-
ing pressure, be, and the same is, hereby accepted and that
a contract for the furnishing of said water pipe and fittings
be, and the same is, hereby awarded to said American Pipe and
Construction Co.; and
BE IT FURTHER RESOLVED that the award of a contract
to said American Pipe and Construction Co. is declared to be
for the approximate quantities set forth in the notice in-
viting sealed proposals; and

BE IT FURTHER RESOLVED that said American Pipe and
Construction Co. be, andthey are hereby, required to execute
a contract, in required form satisfactory to the City of
Anaheim and upon the terms and conditions specified in the
notice inviting sealed proposals and the proposal submitted
by it, and in accordance with the specifications for concrete
cylinder water pipe and fittings as set forth in said notice
inviting sealed proposals for the furnishing of said concrete
cylinder water pipe and fittings hereinabove more particularly
set forth and specified, in all required lengths, at the
prices as follow:

BE IT FURTHER RESOLVED BY the City Council of the City
of Anaheim that said bid be, and the same is, hereby accepted
and said contract awarded for the above specified Concrete
cylinder pipe and fittings, F.O.B. point of shipment, with
freight allowance to Trenchside, Anaheim, California, said
pipe and fittings to be delivered as follows:
The design and layout drawings to be presented
within two weeks from receipt of plans and profile, and
pipe deliveries to commence forty -five (45) days after ap-
proval of layout drawings and to be completed within twenty
five (25) days thereafter; and
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to execute for andon behalf of the City of Anaheim
with said American Pipe and Construction Co. a written contract
for the furnishing of said concrete cylinder water pipe and
fittings hereinabove set forth, and in accordance with the
specifications therefor set forth in a notice inviting sealed
proposals and the terms of this resolution and the contract
approved by the City Attorney of the City of Anaheim; and
BE IT FURTHER RESOLVED that said contract shall con-
tain a provision that should said American Pipe and Construction
Co. fail or neglect to furnish said concrete cylinder water
pipe and /or fittings in accordance with said specifications and
the sealed proposal submitted by it and accepted by the City of
Anaheim within the time herein specified, that they shall, in
addition to any other penalties provided in the contract
documents, be liable to the City of Anaheim for all loss or
damage that the latter may suffer on account thereof.
THE FOREGOING RESOLUTION is signed and approved by
me this 23rd. day of June, 1953.
