A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
APPROVING THE FINAL REPORT OF THE ENGINEERING COMMITTEE
DETERMINING THE PERCENTAGE OF OWNERSHIP AND CAPACITY
RIGHTS AND THE PRESENT VALUE THEREOF OF EACH OF THE
CITIES AND SANITARY DISTRICTS OF THE ORANGE COUNTY JOINT
OUTFALL SEWER IN THE EUCLID TRUNK SEWER LINE, AND DETER-
MINING THE OWNERSHIP AFTER COMPLETION OF THE MAGNOLIA
TRUNK SEWER, AND DETERMINING THE GAIN OR LOSS IN OWNER-
SHIP IN SAID EUCLID TRUNK SEWER.

WHEREAS, The Engineering Committee of the Orange County Joint Outfall
Sewer was heretofore authorized and directed to compute and determine the pre
centage of ownership, capacity rights and the present value thereof of each of
the Cities and Sanitary Districts in the Euclid Trunk Sewer line as such per-
centages of ownership and capacity rights existed prior to the completion of the
Magnolia Trunk Sewer, and to compute and determine the ownership and capacity
rights which each of said Cities and Sanitary Districts would have after the com-
pletion of said Magnolia Trunk Sewer, and to determine the gain or loss in owner-
ship of each of said Cities and Sanitary Districts in said Euclid Trunk Sewer re-
sulting from the completion of the Magnolia Trunk Sewer and the transfer of owner-
ship and capacity rights in said Euclid Trunk Sewer; and
WHEREAS, the Magnolia Trunk Sewer, Pumping Plant and Force Main has now
been completed and is in use and operation, and the final cost of construction
thereof has been finally determined; and
WHEREAS, said Engineering Committee has finally computed and determined
the percentages of ownership, capacity rights and the values thereof of said Cities
and Sanitary Districts in each section of the Euclid Trunk Sewer as they existed
prior to the completion of the Magnolia Trunk Sewer, Pumping Plant and Force Main,
and have determined the percentages of ownership and capacity rights of each of
said Cities and Sanitary Districts in each section of said Euclid Trunk Sewer after
the completion of the Magnolia Trunk Sewer, and determined the gain or loss in
ownership and capacity rights in said Euclid Trunk Sewer arising by reason of the
completion of said Magnolia Trunk Sewer, Pumping Plant and Force Main, and the
transfer of ownership and capacity rights in said Euclid Trunk Sewer, which final
determination of percentages of ownership and capacity rights are as shown on
"Exhibit A" hereto attached and made a part hereof; and
WHEREAS, the City Council of the City of Anaheim hereby finds that the
report of the Engineering Committee computing and determining the percentages of
ownership, capacity rights and value thereof of each of the City and Sanitary
Districts in the Euclid Trunk Sewer prior to and after the completion of the
Magnolia Trunk Sewer, Pumping Plant and Force Main, and the gain or loss in owner-
ship therein as shown on "Exhibit A" hereto attached, should be approved, and that
transfers of ownership in said Euclid line should be made as therein shown.
NOW, THEREFORE, be it resolved by the City Council of the City of Anaheim
that the report of the Engineering Committee as shown on Exhibit A" hereto attached
and made a part hereof, showing the percentage and the value thereof of each of said
Cities and Sanitary Districts in each section of the Euclid Trunk Sewer of Orange
County, California, before and after the completion of the Magnolia Trunk Sewer, and
the gain or loss in ownership in said Euclid Trunk Sewer be, and the same is hereby
approved and that the percentages of ownership and capacity rights of each of said
Cities and Sanitary Districts in said Euclid line be, and the same are hereby fixed
and determined as shown in said "Exhibit A" hereto attached, and that the percent-
ages of ownership and capacity rights of each of said Cities and Sanitary Districts
in said Euclid Trunk Sewer shall, upon final approval of said Engineering Committee
report by all of said Cities and Sanitary Districts be as shown on said Exhibit
after the completion of the Magnolia Trunk Sewer.
AND BE IT FURTHER RESOLVED that each of the Cities and Sanitary Districts
surrendering or transferring percentages of ownership and capacity rights in said
Euclid Trunk Sewer shall be compensated therefor upon the values determined by said
Engineering Committee, as set forth in said "Exhibit A" hereto attached, and that
the Cities or Sanitary Districts receiving such additional ownership and capacity
rights in said Euclid Trunk Sewer shall pay therefor in accordance with the values
established and set forth in said "Exhibit A" in proportion to the value which the
percentage of ownership and capacity rights reveived by each of them bears to
the total value determined by the Engineering Committee.
BE IT FURTHER RESOLVED that the transfers of percentages of ownership
and capacity rights by the Sanitary Districts of La Habra, and Buena Park to the
Cities of Anaheim and Fullerton and to the Placentia Sanitary District as shun on
said "Exhibit A" be, and the same are hereby consented to and approved.
