56R-3141 - RES,LUTION NO. 3141 ,- A RESOLUTION OF THE CI~I COUNCIL OF THE CITY OF ANAFlliIM ACCEPTING THE OFFER OF R. J. NOBLE COMPANY TO FURNISH ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND Truu~SPORThTION, INCLUDING PO'NER, FUEL AND WATER, AND TO PERFORM ALL WORK NECESSARY FOR THE PAVING OF A PARKING LOT ON HELENA STREEl' BETWEEN OAK AND CFillSTNUT STREETS, JOB NO. 374; AND AUTI~ORIZING THE EM~CUTION OF AN AGRE~1ENT TO BE EADie: AND ENTERED INTO \oJITH SAID R. J. NOBLE COHPANY. WHEREAS, the City Council does find and determine that publiC convenience and neoessity require the paving of a parking lot on Helena Street, Between Oak and Chestnut Streets, in the City of Anaheim, Job No. 374; and WHEREAS, R. J. NOBLE COMPANY, Orange, California, has offered to furnish all plant, labor, services, materials and equipment, and all utilities and transportation, includ- ing power, ~lel and water, and to perform all work neoes- sary to pave said parking lot on Helena Street, between Oak and Chestnut Streets, Job No. 374, in striot accordance with the speoifications, plans and drawings therefor on file in the office of the City Engineer of the City of Anaheim, for the sum of $3,464.50; and WHEREAS, the City Council finds that said price is the lowest obtainable for the paving of said parking lot in aocordance with the specifications hereinabove referred to, and that the offer of R. J. Noble Company should be aooepted upon the conditions hereinafter set forth. NOW, ~{EREFORE, BE IT RESOLVED by the City Counoil of the City of Anaheim that the offer of R. J. Noble Company, P. O. Box 620, Orange, California, to furnish all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and to per- form all work necessary to pave a parking lot on Helena Street, Between Oak and Chestnut Streets, in the City of Anaheim, Job No. 374, in accordance with the specifications, plans and drawings therefor on file in the office of the City Engineer of the City of Anaheim, be, and the same is hereby, aocepted, upon the following conditions: - 1. That R. J. Noble Company shall commenoe the work hereinabove mentioned immediately fol- lowing the execution of a contract to be made and entered into by and between said R. J. Noble Company and the City of Anaheim, and shall continue in a due and diligent workmanlike manner, without interruption, un- til said job is oompleted. 2. That in the furnishing of all plant, labor, services, materials and equipment, and all llti 11 ties and transportation, and the per- formance of said work it shall be expressly understood and agreed that R. J. Noble Com- pany is acting as an independent oontractor and not as an agent, servant or employee of the City of Anaheim. '*"'*". .,...,... AIID BE IT B'URTHER RESOL\~D that the purchase price for the furnishing of all plant, labor, services, materials and equipment and aU utili ties and transportation, and the performance of all work necessary for the paving of said parking lot, Job No. 374, shall be paid to the said R. J. Noble Company as follows: 85% thereof upon the completion and acceptance of said work, and the remaining 15% thereof thirty (30) days after the filing of notice of completion of said Job No. 374 by the City. BE IT FUaTHER RESOLVED that said R. .J. Noble Company shall carry public liability and property damage insurance in an amount not less than $100,000.00 for injuries including accidental death, for anyone person, and subjeot to the same limit for each person in an amount not less than $300,000.00 on account of anyone accident, and property damage insuranoe in an amount not less than $50,000.00; and shall take out and maintain during the lif'e of said contract workmen IS oompensa- tion insurance covering all of its employees on the projeot; and public liability and property damage insuranoe to oover vehicles used or maintained by it in the performance of said work conneotedwith said improvement, with liability limits of not less than $50,000.00 for anyone person and $100,000.00 for anyone accident, and property damage of $10,000.00. That said R. J. Noble Company shall also furnish a faithf'ul perf'ormance bond and a labor and material bond for 100% of the cost of said public improvement. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to enter into a contract with said R. J. Noble Company, in the usual form approved by the City Attorney, upon the terms and oonditions herein specified, and the terms contained in the standard form of contract of the City of Anaheim for public improve- ments. me this THE FOREGOING RESOLUTION is signed and approved by 14th day of February, 1956.
