RESOLUTION NO. 3129
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
AND ACQUISITION OF CERTAIN REAL PROPERTY
FOR PUBLIC PURPOSES, AND RESCINDING RESO-
LU'l'IOB NO. 3115.
WHEREAS, DOl"in Hulburt, is the owner of the here in-
after described real property situated in the City of Anaheim,
County of Orange, state of California; and
WHEREAS, said owner has offered to sell said property
to the City of Anaheim for the sum of $15,000.00 cash, lawful
money of the United States; and
WHEREAS, the City Counoil does find and determine
that publio convenience and necessity require the purchase and
acquisition of said paroel of real property for public pur-
poses, and that the price which the owner thereof is willing
to aocept is reasonable and not out of proportion to the
reasonable value of said property.
NOW, THEREFORE, BE IT RESOLVED by the City Counoil
of the City of Anaheim that the offer of Dorwin Hulburt to
sell said property, situated in the City of Anaheim, County
of Orange, state of California, described as follows, to wit:
The East 54 feet of House Lot No.2), as
per map thereof recorded in Book 4, Pages
629 and 630 of Deeds, Records of Los Angeles
County, California;
EXCEPTING therefrom the South 3 feet oonveyed
to the City of Anaheim for sidewalk purposes.
for the sum of $15,000.00 cash, lawful money of the United
States, be and the same is hereby aocepted, subject to the
following terms and conditions:
1. That possession of the rear house on the above
described premises is to be retained by Dorwin
Hulburt, the present owner, for a period of
sixty (60) days from and after the close of
escrow.

2. That all furniture and fixtures in the dwell-
ings now on said premises, and the vines and
shrubs located thereon, shall remain the per-
sonal property of the present owner, Dorwin
Hulburt, and shall be removed on or before
sixty (60) days after close of escrow.
J. That subject property shall be conveyed to the
City of Anaheim free and clear of all enoum-
brances except the second half of General and
Special Taxes for the fiscal year 1955-56. and
taxes which are not yet due, including special
distriot levies, payment of which is included
therein and collected therewith; and all
covenants, conditions, restrictions, reserva-
tions, rights, rights-of-way and easements of
record.

BE IT FURTHER RESOLVED tha.t the City Administrator
of the City of Anaheim be, and he is hereby, authorized for
and on behalf of the City of Anaheim, to sign escrow instruc-
tions for the purchase of said real property and to enter into
an escrow with the owner of said property at All Service
Corporation, 211 East Center street, Anaheim, Californiaj
AND BE IT FURTHER RESOLVED that the City Treasurer
be, and he is hereby, authorized to draw from the City General
Fund and deposit in esorow at All Service Corporation, 211
East Center Street, Anaheim, California, the sum of Fifteen
Thousand Dollars ($15,000.00) cash, lawful money of the United
States, to be paid to the owner of said real property when a
deed conveying said property to the City of Anaheim free and
olear of all encumbrances, exoept as hereinabove set forth,
can be recorded and a polioy of title insurance issued by a
reputable title company showing said property vested in the
City of Anaheim as hereinabove speoified;
AND BE IT FURTHER RESOLVED that the seller shall pay
the usual and customary seller's charges for furnishing a
policy of title insuranoe necessary to show title vested in
the City of Anaheim, as herein provided, and that the City of
Anaheim shall pay the usual buyer's share in the purchase of
said property.
RESOLUTION NO. 3115, approved January 31, 1956, is
hereby rescinded.
THE FOREGOING RESOLUTION is signed and approved by
me this 14th day of February, 1956.
