1953-2133r RESOLUTION NO. 2133 A RESOLUTION OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDONMENT OF AN EASEMENT UPON, OVER, ACROSS AND ALONG CERTAIN REAL PROPERTY, ON VERMONT AVENUE. WHEREAS, the City Council of the City of Anaheim, a muni- cipal corporation of the State of California, did on the 10th day of March, 1953, pass its Ordinance No. 838, entitled "AN ORDINANCE OF THE CITY OF ANAHEIM DECLARING THE INTENTION OF THE CITY COUNCIL TO VACATE AND ABANDON AN EASEMENT UPON, OVER, ACROSS AND ALONG THE HEREINAFTER DESCRIBED REAL PROPERTY AND FIXING A TIME AND A PLACE FOR A HEARING THEREON AND DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS ORDINANCE whereby it declared its intention to vacate, abandon and close to public use an easement for sewer, water and pole lines upon, over, across and along the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: and The Southerly ten feet of the Northerly half of Vermont Avenue (formerly known as Broad Street) reserved by Ordinance No. 241, a certified copy of which order was recorded April 22, 1930 in Book 380, Page 14, of Deeds, Document No. 11391, Records of Orange County, for an easement for sewer, water, pole lines, etc., from the said north half of Vermont Avenue (formerly known as Broad Street) which half street was abandoned by Resolution of Intent No. 98, dated February 29, 1912, extending from the west line of South West Street to the east line of Walnut Street; WHEREAS, said City Council did by said Ordinance fix the 7th day of April, 1953, at the hour of 8 :00 &clock P.M. in the City Hall of the City of Anaheim as the time and place for a public hearing on the matter of such vacation and abandonment and use of said easement for sewer, water and pole line purposes for all per- sons interested in or objecting to such proposed vacation and abandonment to appear and show cause, if any they have, why such easement and the use thereof for the purposes hereinabove mention- -1- 13 12 ed should not be vacated and abandoned; and WHEREAS, said Ordinance was published on March 13, 1953, in the Anaheim Bulletin, a newspaper of general circulation, print- ed, published and circulated in the City of Anaheim, Orange County, California; and WHEREAS, by said Ordinance said City Council directed of that notice the passage of said Ordinance and of time and place of the hearing on the matter of such vacation and abandonment of said easement be posted conspicuously along the line of said ease- ment not more than 300 feet apart and not less than three such notices should be posted; and WHEREAS, George E. Holyoke, City Engineer and Superintend- ent of Streets, did on March 30, 1953, post conspicuously Seven- teen such notices along the line of said easement, which notices were posted less than 300 feet apart; and WHEREAS, said City Council did on April 7, 1953, at 8 :00 ololock P.M. at said City Hall conduct a public hearing on the matter of whether said easement for sewer, water and pole lines upon, over, across and along the hereinabove described real property situated in the City of Anaheim, County of Orange, State of California, should be vacated, abandoned and closed to public use, and at said hearing did hear evidence thereon. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM: 1. That it finds the recitals hereinabove set forth in this resolution to be true. 2. That it finds from all of the evidence submitted that said easement for sewer, water and pole lines upon, over, across and along the hereinabove described property is unnecess- ary for present or prospective public purposes. 3. That it does hereby order that said easement for sewer, water and pole lines upon, over, across and along the -2- hereinabove described property be, and it is hereby, vacated, abandoned and closed to public use. 4. That said easement ordered, vacated, abandoned and closed to public use is that certain easement described in said Ordinance No. 838 and is situated in the City of Anaheim, County of Orange, State of California as more particularly hereinabove described.
