RESOLUTION NO. 311~
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
AND ACQUISITION OF CERTAIN REAL PROPERTY
FOR PUBLIC PURPOSES.
WHEREAS, Dorwin Hulburt, 1s the owner of the herein-
after desoribed real property situated in the City of ~ahe1m,
County of Orange, State of Calirornia; and
WHEREAS, said owner has offered to sell said property
to the Oity of Anaheim for the sum of $15,000.00 cash, lawful
money of the United States; and
WHEREAS, the City Counoil does find and dete~in.
that public convenience and necessity require the purchase and
acquisition of said parcel of real property for public pur-
poses, and that the price which the owner thereof is willing
to aooept is reasonable and not out of proportion to the
reasonable value of said property.
NOW, THEREFORE, BE IT RESOLVED by the City CouDcil
of the City or Anaheim that the offer or Dorwin Hulburt to
sell said property, situated in the City of Anaheim, County of
Orange, State of California, described as follows, to wit:
The East 54 feet of Original City Lot No. 23,
as per map thereof recorded in Book 4, Pages
629 and 630 of Deeds, Records of Los Angeles
County, California;
EXCEPTING therefrom the South 3 feet conveyed
to the City of Anaheim for sidewalk purposes.
for the sum of $15,000.00 oash, lawful money of the United
States, be and the same is hereby accepted, subject to the
following terms and conditions:
1. That possession of the rear house on the above
desoribed premises is to be retained by DorwiD
Hulburt, the present owner, for a period of
sixty (60) days from IUld after the c lose of
esorow.
2. That all furniture and fixtures in the dwell-
ings now on said premises, and the vines and
shrubs looated thereon, shall remain the per-
sonal property of the present owner, Dorwin
Hulburt, and shall be removed on or befol"e
sixty (60) days after close of escrow.

3. That subject property shall be conveyed to the
Ci ty of Anaheim free and clear of all encWYboi
branoes exoept the second half of General and
Special Taxes for the fiscal year 1955-56, an4
taxes which are not yet due, inoluding special
district leVies, payment of which is included
therein and collected therewith; and all
covenants, conditions, restriotions, reserva-
tions, rights, rights-~f-way and easement. of
reoord.

BE IT FURTHER RESOLVED that the City Administrator
of the City of Anaheim be, ani he is hereby, authorized for
and on behalf of the City of Anaheim, to sign escrow instruc-
tions for the purchase of said real property and to enter into
an escrow with the owner of said property at All Service
Corporation, 211 East Center Street, Anaheim, California;
AND BE IT FURTHER RESOLVED that the City Treasurer
be, and he is hereby, authorized to draw from the City General
Fund and deposit in escrow at All Servioe Corporation, 211
East Center Street Anahetm, California, the sum of Fifteen
Thousand Dollars <'15,000.00) cash, lawful money of the United
States, to be paid to the owner of said real property when a
deed conveying said property to the City of Anaheim free and
clear of all encumbranoes, except as hereinabove set forth,
can be reoorded and a policy of title insurance issued by a
reputable title company showing said property vested in the
City of Anaheim as hereinabove specified;
AND BE IT FURTHER RESOLVED that the seller shall pay
the usual and oustomary seller's charges for fUrnishing a
policy of title insuranoe neoessary to show title vested in
the City of Anaheim, as herein provided, and that the City of
Anaheim shall pay the usual buyer's share in the purchase of
said property.
THE FOREGOING RESOLUTION is signed and approved by
