56R-3112 ,- .- RESOLUTION NO. 3112 f' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING V~ANCE NO. 469 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from the owner of oertain real property situated in the City of An~eim, County of Orange, Itate of California, described as follows: That portion of the Northwest quarter of the Northeast quarter of Section 17, Township 4 South, Range 10 West, in the Ranc40 Los Coyotes, in the City of Anaheim, County of Orange, state of Cali- fornia, as said Northeast quarter is indicated on a Map of Tract No. 647, recorded in Book 20, page )4, Misc. Maps, records of Orange County, Calif., described as follows: Beginning at a point on the North line of the Northwest quarter of the Northeast quarter of said Seotion, west )18.75 feet from the Northeast corner thereof; thenoe South )00 feet; thence West 140 feet; thenoe North )00 feet to the North line of said Northwest quarter of the Northeast quarter; thence East 140 feet to the point of beginning. (Said property is looated at 10662 Lincoln Avenue, Anaheim, California.) AND WHEREAS, the City Planning Commission did hold a publio hearing at the City Hall in the City of Anaheim on >>.pem- ber 19, 1955, notices of which said public hearing were duly given as required by law and the prOVisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due in- spection, investigation and studies madJ by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 97 -- Series 1955-56, granting said variance upon the condition therein stated; and 1"""\ WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upen its own motion, to review the aotion taken by the City Planning Commission in granting said variance and did set a pUblic hearing thereon to be held on the 24th day of January, 1956, at 7:00 o'olook P.M., in the City Hall in the City of Anaheim, and notioe of such publio hearing was duly given as required by law and the provisions of Seotion 9200.17 of the Anaheim Muacipal Code; and WHEREAS, at the time and plaoe fixed for said publio hearing, the City Council did duly hold and conduct such publio hearing and did give all persons interested therein an opportun- ity to be heard, and did oontinue said hearing to January 31, 1956; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearings, the City Council does find that: -1- - - r- 1. There are exoeptional or extraordinary circum- stances or conditions applic~ble to the property involved or to the intended ~se of the property that do not apply generally ~o the property or class of use in the same vicinity and zone. 2. That such varianoe is necessary for the pre- servation and enjoyment ofa substantial property right possessed by other p~operty in the same vioinity and zone and denied to the property in question. J. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in suoh vicinity and zone in which the property is located. 4. Th.at the granting of such 'tarlance will not ad- versely affect the comprehensive general zoni~g plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be. and the same hereby is, granted to WILLIAM T. McMANUS, 1964 Irvine Avenue, Costa Mesa, California, to use the present one- family dwelling on the hereinabove described property for pro- fessional offices, upon the following oonditions: 1. That the frontage along Lincoln Avenue be improved as required by the City Engineer.- 2. That the perspective showing the eventual) development of said property, presented to the City Council at said hearings, be filed with the City Clerk and that said Varianoe No. 469 be granted permitting the use of said dwelling for professional offioes, on oondition that ultimate development be made as per said perspective. The City Counoil hereby reserves the right to revoke such variance permit for good cause or failure of said owner or his heirs, sucoessors or assigns to comply with the Anaheim Municipal Code and regulations, and the conditions herein. Said variance is granted for the term presoribed by the Anaheim Muni- oipal Code unless otherwise specified herein.
