1953-2106RESOLUTION NO. 210E A RESOLUTION OF TH7 CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING TING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THF, LO1EST RESPONSIBLE BIDDER FC 'T' TUBI911ING OF ALL PLAT, LABOR, SERVICES IATEIALS AND EQUIt T AD UTIL- ITI ES A•L TRAM;: Ci J \TION INCLJDINCT POWr:?, FUEL AND WJ;'TE AND PF<5 O=NCT ALL WORK Nr CESS^,RY TO CON F; ?C1 AD C( E THE FOLLO INC PUBLIC IMPRGVE ,J :i SOUTH WEST STREET PROJECT NO. 1 7 WHEREAS, the City Council of the City of Anaheim did cause be published in a newspaper of general circulation, printed pub 1_shed and circulated in the City of Anaheim, to wit: The Anaheim of January, ;1953 Bulletin, on the let dayfand the 4th day of February____, a notice inviting sealed proposals for furnishing the fol- lowing: All plant, labor, services, materials and equipment and all utilities and transportation including power, fuel and water and performing all work necessary to construct and complete the improve- ment of South West Street from Santa Ana Street to Vineyard Avenue, full width between gutters by the removal of existing materials and paving with 4-- -inch plant -mixed surfacing according to the plans and specifications, and adjusting all existing manholes to grade. in accordance with the designs, plans, profiles and specifications of said public improvement on file in the office of the City Clerk of the City of Anaheim; and WHEREAS, said notice inviting sealed proposals for said u .bile improvement did provide that sealed proposals would be received by the City Council of the City of Anaheim at the office of the City Olork of the City of Anaheim up to the hour of 8:00 olclock P. M. on th.3 losa day of February 19_11, for the furnishing -1- of all plant, labor, services, materials and equipmen, all utilities and transportation including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner the public improvement hereinabove more particularly mentioned and described and which notice did state and declare that pursuant to the provisions of Section 177) of the Labor Code, the City Clerk of "Ze City of Anaheim had ase 'u&ined the prevailing rate of wages in `e locality in which this type of labor is to be performed for each ;gait or type of workman or mechanic needed to execute the contract a.Y did set forth the prevailing hourly wage scale so ascertained; and WHEREAS, the City Council of the City of Anaheim did receive following sealed proposals prior to 8 :00 o'clock P. M. on the 10th day of Febru y 1912_ in response to the notice aforesaid inviting sealed proposals, to wit: UNIT BID PRICE TOTAL PRICE R. J. Noble Company P. O. Box 620 Orange, California Sully Miller Contracting Co. P. O. Box 432 Orange, California John J. Swigart Company P. 0. Box 710 Orange, California $5,939.50 $6,083.00 $6,658.75 WHEREAS, the City Council did thereupon refer said bids to the CitX Eineer for examination, tabulation and report to the City Council, and said ,City Engineer did examine and tabulate said sealed proposals and did report to the Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed proposals submitted by R. J. Noble Company_ P. O..Box .29 Orange, CaliZorDia is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, fuel and water and performing all work necessary to construct and complete in a good and workmanlike manner in strict accordance with the specifications, plans and drawings therefor on file in the office of the City Clerk of the City of Anaheim of the public improvement hereinbefore mentioned and described te,ether with the appurtenances thereto and as specified in the notice inviting sealed proposals and that said proposal of said above named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the City Council finds that the above mentioned sealed proposal is the lowest responsible proposal received and that e person, firm or corporation submitting said proposal is a respon- ,ible person, firm or corporation and that the proposal submitted is he best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AYAHF'IM that the sealed proposal submitted by R. J. Noble A. a Ti r Box 62 Y the furnishing of all plant, labor, services, materials and equip t, all utilities and transportation, including power, fuel and cr and performing all work necessary to construct and complete in a,od and workmanlike manner in strict accordance with the specifi- w °ions,, plans and drawings therefor on file in the office of the 3-. City Clerk of the City of Anaheim and the notice inviting sealed pro- posals, the public works and improvements hereinabove more particu— larly mentioned and described, together with the appurtenances there— to, be, and the same is hereby, accepted, and that a contract for the construction and completion of said public improvement be, and the same is hereby, awarded to the said above named bidder. AND BE IT FURTHER RESOLVED that the successful bidden or bidders upon each contract awarded as hereinabove set forth shall be, and they are hereby required to execute a contract in the required form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications fcr said public improvement hereinabove described aid in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract isawarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100 of the contract price for all labor, materials and equipment to be furnished and performed as set forth in the sealed proposal submitted by said bidder for the con struction of said public improvement together with the appurtenances ::hereto or such portion thereof as is covered by said contract as -;curity for the faithful performance of said contract and a separate earety bond in an amount equal to one hundred per cent (100 of the construction cost of said public improvement covered by said contract ae security for the payment of all persons performing labor and furn— eshing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or b `iders be, and they are hereby, required to furnish to the City of knaheim in companies satisfactory to the City of Anaheim public 'lability, property damage, compensation, and other insurance in the amounts and for the purposes as set forth and specified in the notice ATTEST: inviting sealed proposals and subject to the approval of the City Attorney as to form and sufficiency. AND BE IT FURTHER RESCLVED that the ayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to make, execute and enter into for and on behalf of the City of Az heim a written contract with said successful bidder or bidders for the furnishing of all plant, labor, materials, and equipment and Performing all work as hereinabove more particularly described for the construction, installation and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, pro- files, drawings and general specifications and detailed specifications and drawings and all addenda thereto and all modifications incorporated therein prior to the date of the opening of bids, on file in the office of the City Clerk of the City of Anaheim and in strict accordance with the terms, conditions and provisions of this Resolution, and in accordance with all the contract documents herein specified.
