Jaycox has submitted to the City Council offer to remove all garbage from the City of Anaheim for a period of three yeare from March 1, 195) to February 28, 1956, for the sum of .000.00 per month as full comoeneation for furnishing all labor equipment and materials and for perferming and completing all the work which is necessary or proper to be furniehed or performed in the collection, removal and disposal of all garbage within the City Limite of the City of Anaheim a the same now exists or may hereafter be altered or extended for the period of time above mentioned; and WHEREAS, the City Council finds that It would be to the advantage and for the best interest of the City of Aneheim to enter into a contract Kith the said earren W. Jaycox for the collection, removal and disposal of said garbage and will be more economical and will result in a savings to the taxpayers of the City; and WHEREAS, said Warren W. Jaycox has submitted to the City of Anaheim a form of contract dated the let day of March, 1953, ta be made aid entered into by an between the City of Anaheim and said Warren W. Jaycox for thecollection, removal and disposal of said garbage, containing terms, provisions and conditione satis- factory to the City Council. NOW, THFREFORE, BE IT RESOLVED by he City Council of the Gity of Anaheim that a contract be, and the same is hereby, 1 11 awarded to Warren We Jaycox for the furnishing of all labor equip- 2 ment and materials and for performlng and completing all of the 31 work which is necessary or proper to be furnished or performed for 4; the collection, removal and disposal of all garbage from within 5 the City of Anaheim as it now exists or may hereafter be altered 6 or extended for a period of three (3) years from the let day of 7 March, 1953, to the 28th day of February, 1956, upon the express 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30. 31 32 terms amd conditions as set forth in the Agreement dated the 1st day of March, 1953, eubmitted herewith, which Agreement is hereby approved.. AND BE IT FURTHER RESOLVED that the City agrees to pay and said contractor agrees to receive as full compensation for furnishing all labor, equipment and materials and performing and completing all work necessary for the collection and removal of said garbage in accordance with the terms and provisions of said. contract the sum of 4900.00 per month, payable on the 10th day of each and every month for all mate tale and equipment furnished and labor performed for the preceding calendar month. AND BE IT FURTliaR RESOLVED that said. Warren. W. Jaycox be, and he is hereby, required at the time of the execution of said contract to furnish the City a good end sufficlent surety bond approved by the Superintendent of streets and the City Attorney in the sum of 410,000.00 coneltipned upon the faithful performance of said contract and that said ierren W. Jayeox be, and he is hereby, requlred to furnish the City an additional good and Buff n' surety bond in the GUM of 5,000.00 conditioned upon the prompt payment by said contractor of all just and legal claims for meteria and labor or obligations of whatever neture arising directly or indirectly for the performance of the work herein authorized and provided for and as specified in said contract. Jaycox be, and he is hereby required to carry at his own expense full coverage Workmen's ComeensatiOn:Insurance covering ell persons employed by him, and public liability insurance in an amount not less than 100,000.00 for injuries including accidental death for one person and, subject to the same limits for each person in an amount not less than 300,000.00 any one accident, and, property damage in an amount not less than damage insurance shall cover both general liability of said con- tractor and all vehicles used by him In the perfermance of said contract. IAYCOX, hereinafter called the Contractor. The terra of this agreement is a period of three years, from ea oh 1, 1953 to February 2., 1955. Contractor shall have the option to renew this agreement for an additional period of one, two or three years by ,iving written notice of his intention so to do not later than Janua 1. 1955. In the event this agreement is hereafter provided. 6. In c ed, the compensation to be paid to Contractor shall be as side ration of the premises, the City agrees to pay, and the Contractor shall receive, as full compensation for fur t:in hi all labor, equip- ment and materials and for performing and corapiettng al.l the work which is neoee4 nary or proper to be furnished or performed in order to complete said requiremens in this contract embraced and in said specifications described and shown, and II also for all expenses incurred by or in consequence of the suspension or dis- continuance of the work, the sum of Sine hundred Dollars ($900.00) per month. 7. In the event that any of the provisions of this contract are violated by the Contractor, the City may, at its election. terminate the con- tract by serving written notice upon the Contractor of its intention to term- inate such contract, and unless within ten (10) days after the serving of such notice, such violation shall cease, the contract shall upon the expiration of said ten (10) days cease and terminate. As to violations of the provisions of this contract which cannot be remedied or corrected within ten (10) days, said contract, at the election of the City, shall cease and terminate upon the giving of written notice. If the contractor should be adjudged bankrupt or should make a general assignment for the benefit of creditors or a receiver should be appointed on the account of insolvency of the contractor or if the Contractor should persistently and repeatedly refuse or should fail to supply enough pro- perly skilled workmen or ?groper materials or equipment for the collection and disposal of garbage in the City of Anaheim, as herein provided, in a good work- manlike manner or should he fail to make prompt payment for materials or equip- went or labor or persistently disregard laws, ordinances, or the instructions 3. 2 3 4 5 6 7 8 CITY OF ANAHEIM 204 E. It is further understood and agreed that should the contractor fail. to furnish labor, materials and equipment to do and perform all the work and labor provided! herein the manner set forth in a good and wort anlike canner, he shall, in ad- dition to any other provisions present in the contract documents be liable to the City for all losses of damages that the latter may suffer on the account thereof. 8. The contract, of which these specifications are a part, ehall cover the collection and dispoeal of all garbage in the City within the limits hereinafter given, which limite may Loreafter be altered or extended by the City in the mewr and under the conditions hereinafter provided, for a period of time extending from the 'irat day of Xerch 1953, to rebruary 28, 1955. (b). The Contractor will, without cost to the City, furnish ell labor and equipment necessary for the collection f all garbage. The equipment used for the collection of garbage hall be so constructed as to prevent any leakeec of liquids or lees of solids on streets, alleys or place of dieposal, except at the proper point of deposition, end the eecision of the Street Superintend.ent shall be final as to the adaptability and adequacy of the equipment. All moviag equipment is to heve tu operator at its controle at all times. (c). The City will designate by ordinance or otberwiee the type or kind of garbage centaleere from which the Contractor will be require& to make collections and the Contractor will not be required to make collections from container* of a type or kind not approved by the Superintendent of Streets. (d). The Contractor will not be required to maks any collections of garbage unlese such garbage cen be reached with reoeonable convenience from n street or alley. Under the provisions of City Ordinance, the Supertntentont of Streets is authorized to approve the location of containers and in the interpree tation of this paragraph his decision stall be final and binding upon the Cone tractor. The Contractor will be required to use reasonable care in the handling of containers and will be required to replace any container damaged b the Contractor or the Contractors employees, if so ordered by the Superintenden of Streets, and to replace containers in an upright position to their original location. ANAHEIM, CALIFORNIA of the work herein provided for, who shall for any reason be unsatisfactory to the Superintendent of Streets an1 ipon notification by the Superintendent of Streets than an employee is nnsatisfactory, the Contractor will immediately re- move such employee permanently from the work. (h). The Contractor shall notify the Superintendent of Streets of any violation on the part of an individual or place of business, of any ordi- nance or regulation pertaining to the collection and disposal of garbage, and any dispute or controversy arising between the Contractor and any other party in relation to the work herein provided for, shall be referred to the Superin- tendent of Streets for settlement. (i). The Contractor ie required to become familiar with and observe all ordinances of the City of Anaheim, and all State and Aderal laws whidh might or could affect the Contractor in the prosecution of the work herein pro- vided for and the compliance with the terms of the contract therefor. (j). The Contractor will nIt be permitted to sublet all or any portioie of the contract without written permission from the City Council. 2. ARAA TO BE, COVSRXD. The Contractor will be required to make the collection and disposal ofl all garbage in that portion of the City as is contained within limits hereinafter described, which limits may, at the option of the Superintendent of Streets, and. in the manner hereinafter provided, be extended to include additional areas. The area to be served as of the date of the contract will be as follow: All that portion of the City included ie ee city limits of Anaheim as shown on official map of the City of Anaheim dated March, 1, 1953, as filed in the office of the City inear of the City of Anaheim and all territory thereafltel annexed to the City during the term of this contract. Secluding from such portions of the City all areas not reached by public street or alley*. From time to time, ee the sole option of the Superintendent of Streets additional portions of the City may be added to the area to be served, under the contract and the limits hereinbefore given shall be altered se as to include such eddite.eaal area. 6- 1. 3. ODLIACTIO N. 2 The Contractor will be required to colloct all garbage between the 3 hours of 7 :00 o'clock A. M. and 4:00 o'clock P. M. of the days specified for 4 such collection. ANAHEIM, CALIFORNIA 29 into four districts by the Superintendent of Streets and designated: Business District, District No, 1, District No. 2 snd District No. 3. The boundaries of the districts will be submitted to the Contractor by the Superintendent of Streets, and, at his option may be altered from time to time, jacent to alleys and the Contractor will be required to make use of alleys in preference to streets in the operation of collections. If, by reason of accident, unusual condition, or the necessity arising from operations of the City or the authorised temporary closing of a street or alley, it is impossible to reach the usual location of a garb a container, or if the sane cannot be so placed as to allow access thereto with the Contractor' hauling equipment, then and in such cases, the Contractor is required to carry such garbage to the hauling equipment, and replace the container in its proper location, without any additional cost to the City. If, in the process of collection, garbage shall be spilled or scattered on any street or alley or private or public property, the Contractor shall cause same to be immediately cleaned up and removed to the satisfaction of the Sxper- Business Distric Pistri.t. DISPOSAL Garbage shall be disposed of by the Contractor and at his or its sole 3 !1 expense and on a site, or sites, to be provided by the Contractor and approved 4 1; by the Superintendent cif Streets and in a manner not in conflict with any City or County Ordinance or order or regulation of its Health or Sanitary Department or S;I with any State or Federal law, regulation or order; said disposal site or sites 7 shall at all times, be accessible to the officials of the City. 8 The Contractor shall report to the Superintendent of Streets twice a 9 year, July first and January first, the amount of garbage collected during the said. sex (6) monthat period. The Contractor shall also give such other information 11 and data as may be required by said Superintendent of Streets. 12 5. The Contractor agrees to accept as full compensation for the complete 18 19 Any complaint received by the Superintendent of Streets from an indi- 20 vidual, firm or corporation affected, as to the manner in which the work herein 23 specified is p performed by the Contractor or an employee of the Contractor shall 22 be the basis for a charge against the Contractor, by the City, of the sum of 23 One Dollar ($1.00) for each and every complaint so received, and the City will 24 withhold from any moneys due or to become due to the Contractor said sum of One 25 Dollar (S1.00) for each and every oompla.int so received, provided said complaint 26 i ts found, after investigation by the Street Superintendent, to :be justified. The 27 amount so charged and withheld i• not a penalty but is a liquidated daiw go. 28 The Contractor shall call at the office of the Superintendent of Street 29 at least once every working day to receive any complaints or instructions. 30 7. DWG/M. 31 For each and ever day on which a collection of y y garbage is specified to 32 6. COMPLAINTS. made and on which no collection of garbage is made, the City shall have the 1 right to charge the Contractor the sum of One Hundred 0100.00) Dollars, unless 2 such right is expressly waived in writing by the City, and the City will with.- 3 hold from any moneys due or to become due to the Contractor said sum of One Hun 4 dred ($100.00) Dollars for each and every day on which no collection is made, 5 unless the right to so do is expressly waived. The amount so charged and with 6 held is not a penalty but is a liquidated damage. 7 The Contractor shall agree to pay any judgment which may be obtained 8 against the City of Anaheim, either alone or jointly with said Contractor, his 9 agents, servants or employees, to persons or property by reason of the performanc 10 or non performance of the terms of the contract; provided that if the City be 11 sued alone for such injury or damage, immediate notice in writing shall be given 12 to the Contractor to appear and defend such action. 13 8. INSURANCE SPECIFICATIONS 14 I The Contractor will be required to carry at his own expense full cove 15 Workmate Compensation Insurance covering all persons employed by him and Publi 16 Liability Insurance in the amount not less than One Hundred Thousand 17 ($100,000.00) for injuries including accidental death for one person and subject 18 to the same limits for each person in an amount not less than Three Hundred 19 I thousand 20 21 22 23 241 29 30 31 32 CITY OF ANAHEIM 204 E. BONDS. 25 The Contractor will be required, at the time of the execution of the 25 1 contract, to furnish the City a good and sufficient surety bond, approved by the 27 Superintendent of Streets, in the full sum of Ten Thousand ($10,000 Dollars 28 conditioned upon the faithful performance of the contract.
