WHEREAS, the City Council of the City of Anaheim did on the 27th day of January 1953 receive a written petition asking that certain new territory described in said petition be annexed to ne City of Anaheim; and WHEREAS, said territory so proposed to be annexed to said City of Anaheim is situated in the County of Grange, State of Calif- ornia, and is contiguous to the City of Anaheim, and said petition contains a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, said petition is signed by not lass than one fourth of the qualified electors residing within the territory hereinafter described, as shown by the County Registration of Voters; "nd WHEREAS, said new territory proposed to be annexed to said City Of Anaheim does not form a part of any municipal cor_)oration, and more than twelve (12) qualified electors resided within the boundaries of the territory :proposed to be annexed at the time of the filing of said petition for said annexation, and said electors are Lona tide residents of said neTT territory and said territory is in- habited; and WHEREAS, on the 27th day of January 19 5q the City Council of the City of Anaheim did adopt its Resolution "To. 2082 declaring its intention to call a special election, and did fix a time and place for the hearing of protests, and give notice of such hearing, and did find and cletermine that the proponents who filed said petition for the annexation on the 27th day of January 1953, had done and performed the things rccuirccl to be done and performed by tho Annexation Act of 1913 (Title IV, Division 2, Part 2, Chapter 1, Art- icles 1 to 4 inclusive) and dicl further find that all of the provis- ions of said Annexation Act of 1913, as amended, required to be complied with before the adoption of said resolution, had been com- plied with prior to the adoption of said resolution, which resolution was duly published as required by law, and WHEREAS, said City Council did, pursuant to its Resolution Yo. 2082 hold a public meeting and hearing on the 13th day of February 4:00 19 53 at the hour of ,c o clock P.ii. in the City Council Chamber of the City Nall of the City of Anaheim, the date fixed in said resolu- tion as thy; day, hour and place when and :7here any and all persons owning real property within the boundaries of the territory so pro posed to be annexed and having any objections to the proposed annexa- tion, might appear before the City Council of the City of Anaheim and show cause why such territory should not be so annexed, which said Resolution i'o. 2082 did notify all persons having any objections to such proposed annexation to appear on said date at said hour and place to show cause, if any they had, why such territory should not be annexed, and further notifying such persons that any protests against the calling, of an election to submit to the electors residing within said territory the question of annexation to the City of Anaheim, and any protests against the annexation of said territory to the City of Anaheim must be in writing and filed with tho City Clerk of the City of Anaheim not later than the hour and date set forth in such resolu- tion for the hearing of objections to said election and the annexation -2- of said territory to the City of Anaheim, which said resolution was duly published once a week for two successive weeks prior to the date fixed for the hearing of protests and objections to said election and annexation of said territory to the City of Anaheim, in the Anaheim 3ulletin, a newspaper of general circulation published and circulated in the City of Anaheim, County of Orange, State of California; and ?AREAS, at said public hearing; held on the 13th day of February 1953 the City Council of the City of Anaheim did hold a hearing to hoar all written protests theretofore filed objecting to the calling of said special election or the annexation of said terri- tory hereinafter described to the City of Anaheim, and the City Council does hereby find that written protests were not made by the owners of a majority of the separate parcels of property within the territory proposed to be annexed,; and WHEREAS, said petition contains a request that the City Coun- cil of the City of Anaheim c.11 a social election to be held in said territory thereby proposed to be annexed to said City of Anaheim and ;riving notice thereof as required by law, and to submit to the elect- ors residing within said territory the question whether said new territory shall be annexed to, incorporated in, and made a part of the City of Anaheim, and said petition also contains a request that t question to be submitted at such special election to the electors residing within said new territory shall be whether said new territory shall be annexed to, incorporated in, and made a part of said City of Anaheim, and the property therein be, after such annexation, subject to taxation equally with the property within the City of Anaheim, to pay its pro rata share, based upon assessed valuation, of all bond,ea indebtedness of the City of Anaheim outstanding or authorized at the ate of the filing of said petition, to wit January 27, 1953 NOW, T' ERETORE, BE IT RESOLVED by the City Council of the Ci t;' of Anaheim that a special election be, and t a same is hereby, called to be held on Friday the 20th day of March 19 53, in said -3- new territory mentioned in the petition aforesaid and hereinafter more particularly described, and proposed to be annexed to the City of Anaheim, for the purpose of submitting to the electors residing in said new territory the question whether the said new territory shall be annexed to, incorporated in, and made a part of the City of Anaheim end the property therein be, after such annexation, ;subject to taxa- ton equally with the property within said City of Anaheim, to ,gay its pro rata share, based upon assessed valuation, of all of tho bonded indebtedness of said City of Anaheim outstanding on the 27th clay of January 1953 or theretofore authorized. The new territory in which such special election is hereby called and shall be held, is situated in the County of Orange, State of .California, the boundaries of which are described as follows: A tract of land including a portion of Sections 2, 3, 4 and 11, Township 4 South, Range 10 West, San Bernardino Base and Meridian and a portion of Sections 34 and Township 3 South, Range 10 West, San Bernardino Base and Meridian, and more particularly described as follows: Beginning at a point on the existing City Limits Line of the City of. Anaheim, said point being at the intersection of the South right -of -way line of East La Palma Avenue and the East property line of Lot 1 of Original Tract No. 153 filed in Book 11, Page 46, M.M.R.O.C. and a distance of 1669 feet more or lees East of the monumented center line of East Street; thence Northerly along a line perpendicu- lar to the monumented center line of East La Palma Avenue for a distance of 30 feet more or less to the South line of Section 2, Township 4 South, Range 10 West, San Bernardino Base and Meridian, said line being the monumented center line of East La Palma Ave. thence continuing Northerly along said line perpendicular to the center line of East La Palma Avenue to the North right -of -way line of East La Palma Avenue; thence Easterly along said North right -of- way line of East La Palma Avenue to its intersection with the East line of a parcel described as the East of Southwest of the South- west 4 of the Southeast 4 of Section 2, Township 4 South, Range 10 Wriest San Bernardino Base and Meridian; thence northerly along said East line to the Southeast corner of Lot 22 of Golden State Tract No. 2, filed in Book 4, Page 68, M.M.R.O.C.; thence Northerly along the East line of said Lot 22 to the Northeast corner thereof, thence continuing Northerly to the Southeast corner of Lot 18 of said Golden State Tract; thence continuing Northerly along the East line of said Lot 18 and Lot 14 of said. S. Highway 101 thence Southerly 410 feet more or less along the said West right -of -way line of Spadra Road and the existing City Limits Line of the City of Anaheim to angle; thence easterly 60 feet more or less continuing along said City Limits Line of the City of Anaheim to a point on the West right of -way line of Lemon Street; said point being 700.12 feet more or less northerly from the Northwest right -of -way corner of said. Lemon Street and Romneya Drive; thence continuing Northerly along said City Limits Line and said West right -of -way line of Lemon Street to an angle point on said City Limits Line, it being the North line of the Kirven Annex- ation to the City of Anaheim as certified by the Secretary of State, January 11, 1946, to an angle point on said City Limits Line; thence Northerly continuing along said City Limits Line a distance of 325.55 feet more or less to angle point on said City Limits Line; thence Easterly continuing along said City Limits line a distance of 665 feet more or less to a point; said point being an angle point in said City Limits Line, it also being the center of Section 3, Township 4 South, Range 10 West San Bernardino Base and Meridian; thence Northerly continuing along said City Limits Line a distance of 1828 feet more or less to an angle point on said City Limits line it also being the Northwesterly corner of the Industrial Site Addition to the City of Anaheim, as certified by the Secretary of State, August 21, 1924; thence Easterly continuing along said City Limits Line a distance of 1328 feet more or less to an angle point on said City Limits Line; thence Southerly continuing along said City Limits Line a distance 4466 feet more or less to an angle point on said City Limits Line, said point also being on the monumented center line of East La Palma Avenue; thence Easterly continuing along said City Limits line a distance of 2755.18 feet more or less to a point of intersection of the said City Limits Line and the West property line of Original Lot 1 of Tract 153 filed in Book 11, Page 46, M.M.R.O.C.; thence continuing Southerly along said City Limits line 31.26 feet to the South right of -way line of East La Palma Avenue and an angle point on said City Limits line; thence Easterly continuing° along said City Limits line 536.46 feet to the point of beginning. MTD EE IT FURTHER RESOLVED that the polls of said election shall bo opened- at 7:00 o'clock A. 1. of the clay of said election and shall remain open continuously from said time until 7:00 o'clock P.M. of the sale clay, when said polls shall be closed, except as °..provided in Section 5734 of the Elections Code of the State of California. AND BE IT FURTHER RESOLVED that at said special election the question whether said new territory shall be annexed to, incorporae:d inn, and Made a part of the City of Anaheim, and the property in said now territory be after such annexation, subject to taxation equally with the property within the City of Anaheirn, to pay its pro rata portion, based upon assessed valuation, of all of the bonded indebted- ness of said City of Anaheim outstanding; on the 27th day of January 1953 or theretofore authorized, shall be submitted to the electors residing in said now territory so proposed to be annexed to said City of Anaheim, That said new territory hereinbefore and in said petition for annexation described is hereby designated as "ACACIA STREET A TiTEXATIOIP' and said territory shall be indicated and referred to by the name of "ACACIA STREET ANNEXATION" to be used at said special election, at which tha question of such anne ,tion of said territory to the City of Anaheim is submitted to the electors of said territory, and the name "ACACIA STREET ANNEXATION" whenever used in the notice of said special election hereby called in said territory, and any and all proceedings for the annexation of said territory to the City of Anaheim shall mean and shall be construed to mean the territory hereinbofore and in said p tition described, and so proposed by said petition to be annexed to said City of Anaheim. The canvass shall bo completed at the mooting if practicable, or as soon as poss- ibla, avoiding adjournments.
