56R-3092 "-._"..~ - RESOLUTION NO. JO~2 r'" A RESOLUTION OF THE CITY COPNCIL OF THE CITY OF ANAHEIM GRANTING V~IANCE NO. 4)6 TO JULY 1, 1956. WHEREAS, the City Planning fommiSSion did receive a petition from Jo An Burdiok, applic nt, and J. W. Thorne, agent, requesting a zoning varianoe f r the following de- scribed real property situated in the'City of Anaheim, County of Orange, State of California, to wit: A portion of Vineyard Lot A~_l. located at the Southwest corner of Nor~h East Street and East Sycamore Street. (419 North East Street, An~eim, California) AND WHEREAS, the City Planning Commission did hold a pUblic he~ring at the City Hall in th~ City of Anaheim on Octo- ber J, 1955, notices of which said pu~lic hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due in- speotion, investigation and studies m~de by itself and in its behalf and after due consideration of all the evidence and re- ports offered at said hearing, did adqpt Resolution No. 55 __ Series 1955-56, granting Variance No. 4)6 until January 20, 1956; and ",......., WHEREAS, upon request made qy said applicant that said variance be reopened and extended indefinitely, the City Planning Commission did duly hold and conduct a pUblic hearing at the City Hall in the City of Anahetm on December 5, 1955, noti~s of whioh said public hearing ~ere duly given as re- quired by law and the provisions of Selction 9200.17 of the Anaheim Munioipal Code; and WHEREAS, said Planning Commi,ssion, after due inspeo- tion, investigation and studies made b~ itself and in its be- half, and after due consideration of all evidenoe and reports offered at said hearing held on Deoember 5, 1955, did adopt Resolution No. 82 -- Series 1955-56, denying an extension of time on Variance No. 436 beyond the 20th day of January, 1956.and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution No. 82 -- Series 1955-56, a written appeal was filed with the City Counoil of the City of Anaheim requesting a review of the action taken by said Planning Commission, and said appeal was set for pub- lic hearing on January 10, 1956 at 7;00 o'clook P.M. at the City Hall, in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said pUblic hearing, the City Council did duly hol~ and conduot such pub- lio hearing and did give all persons i~terested therein an opportunity to be heard and did receive evidence and reports and did thereupon close said hearing amd declare that action would be taken at a later date; and -1- - _. / WHEREAS, after due invest~ation and studies made by itself and in its behalf, and after due oonsideration of all the evidence and reports offered at said hearing held on Jan- uary lOJ 1956, the City Council does find that: 1. There are exoeptional or e(lttraordinary oircum- stanoes or conditions appl~cable to the property involved or to the intende~ use of the property that do not apply generall~ to the property or class of use in the same vicinity and zone. 2. That suoh a variance is nebessary for the pre- servation and enjoyment of a substantial property right possessed by other p~operty in the same vicinity and zone and deni~d to the property in question. 3. That the granting of such variance will not be materially detrimental to the pUblio welfare or injurious to the property pr improvements in such vicinity and zone in which the property is loca ted. 4. That the granting of such variance will not ad- versely affect the oomprehensive general zoning plan. NOW, THEREFORE, BE IT REsOtVED by the City Counoil of the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted to J~ An Burdiok to conduot ballet, tap, acrobatic, Hawaiian, modern and ball room danc- ing, as well as baton and trampoline~ on the above described property looated at 419 North East street, Anaheim, California, until JUly 1, 1956. The City Council hereby re$erves the right to revoke such variance permit for good cause or failure of said Jo An BUrdiok, or her heirs, suocessors or assignBJ to oomply with the Anaheim Municipal Code and regulations, and the oonditions herein.
