CALIFORNIA -1- RESOLUTION NO. .4020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR A PUBLIC IMPROVE- MENT, NAMELY, A PUBLIC PARKING LOT, AND AUTHOR- IZING- THE PURCHASE THEREOF AND ACCEPTING A DEED THEREFOR. WHEREAS, the public interest and necessity require the acquisition and improvement and completion of a public improvement within the City of Anaheim, to wit: A public parking lot or area to relieve the congestion of traffic and to relieve the serious shortage of parking areas within the business section of the City of Anaheim; and WHEREAS, public interest and necessity require the ac- quisition for said public improvement of the real property or interest in real property hereinafter described; and WHEREAS, Elsa G. Rust, the owner of the real property hereinafter described has offered to sell said property in fee to the City of Anaheim for the sum of Twenty-Five Thousand. Five Hundred and 00/100 Dollars ($25,500.00) upon the terms and condi- tions hereinafter set forth; and. WHEREAS, the City Council finds that said condition 22 is reasonable and that said property is needed for public parking 23 purposes and that it will be necessary to improve it and use it 24 for parking purposes for ten (10) yeare or longer and does further 25 find that the price asked for said property is not out of propor- 26 tion of the actual market value of said property and that it would 27 be to the advantage and for the best interest of the City of 28 Anaheim and the citizens and residents thereof to accept said offer 29 purchase said property and devote it to the uses aforesaid. 30 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 31 i THE CITY OF ANAHEIM that the offer of Elsa G. ANAHEIM, CALIFORNIA the City of Anaheim, County of Orange, State of California, more particularly described as follows, to wit: Lots 21 and 22 in Vineyard Lot "E5" of the Langenberger Tract, in the City of Anaheim, County of Orange, State of California, as per Map thereof recorded in Book 1, pages 551 and 552 of Miscellaneous Records of Los Angeles County, California. SUBJECT to the second installment of taxes for the fiscal year 195 53. SUBJECT to conditions, restrictions, easements, reservations and rights of way of record. 10 for the sum of Twenty -Five Thousand Five Hundred. and 00 /100 Dollars 11 ($25,500.00), lawful money of the United States, cash, and upon 12 the condition that said property will be improved within a reason 13 able time and thereafter used for public parking purposes for a 14 continuous period of at least ten (10) years be, and the same is 15 hereby, accepted and the deed tendered by said Elsa G. Rust is 16 hereby accepted, and the City Treasurer be, and he is hereby, 17 authorized and directed to pay out of the Parking Meter Fund to 18 said Elsa G. Rust the sum of Twenty -Five Thousand Five Hundred and 19 00 /100 Dollars ($25,500.00) upon receipt of said deed and a report 20 from a reputable title company showing said Elsa G.
