i'YHER AS, the City Plar+ninL; Co=ission of the City of Anaheim
did rOceive a petition frog the property owner t
of certain real property situated in the City of Anaheim, County
Ora.ngo, State of California, described as follows:
123 to 129 West Center Street, Anaheim, California

i ;'i- TERAS, the City Planning Commission did hold a public hear-
ing at the City Hall in the City of Anaheim upon said petition on
November 3, 1952 notices of ,thich said public hearing <<rere duly
:riven as required by law and the :provisions of Section 9200.17 of
the Anaheim Danicipa l Coda; and
'c!EEREAG, said Commission, after due inspection, investigation
and studies :Lade by itself and in its behalf and after due consider-
ation of all evidence and re,aorts offered at said hearing, did adopt

its Resolution _l o. 21 recomnending to the City Council of the City
of Anaheim that Variance i'o. 176 be granted upon the conditions
stated in said resolution; and
HEa AS the City Council does find that:
1. There aro exceptions or extraordinary circumstances
or conditions applicable to the _property involved or to the
intended use of the property that do not apply generally to
the property or class of usc in tha same vicinity and zone.
2 That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right possessed
by other :.:roperty in the same vicinity and zone and denied
to the property in question.
3. That the granting; of such variance frill not be
Materially detrimental to the public welfare or injurious
to the pro aerty or improvazients in such vicinity and zone
in which the property is located.
4. That the granting of such variance rill not adversely
affect the comprehensive general zoning plan.
NC':r, THEREFORE, DE "T RESOLVED. by the City Council of the
City of i.naheim that a conditional zoning variance be, and the same
is hereby granted to Catherine Gerard, c/o E. U. Bertha 4011 Wilshire
Blvd., Los Angeles, for the use of said ;property for the folloring

The City Council hereby reserves the right to revoke such
variance permit for good cause or failure of said orner or their
heirs, successors or assigns to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the tern prescribed by the Anaheim Municipal Code unless
