FURNISHING OF ALL LABOR, MATERIAL AND EQUIPMENT FOR THE IMPROVEMENT OF WEST VERMONT AVENUE FROM LEYON STREET TO PALM STREET IN THE CITY OF ANAHETM. Improvement of West Vermont Avenue from Lemon Street to Palm Street in the City of Anaheim County Grant from Highway Users Tax.Fund, September 1952, Job No. 328" involving the following approximate quantities: Excavation 1700 Cu.Yds. Plant-Mixed surfacing including Paint Binder 1050 Tons and WHEREAS said notice inviting sealed proposals for such street improvement did provide that such sealed proposals would be receive4 by the City Council of the City of Anaheim at the office of the City Clerk of the City of Anaheim un to the hour of 8:00 o'clock .M. of Wednesday, November 19, 1952, for the furnishing of all labor, materials and equipment aforesaid and which said notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim has ascertained the prevailing rate of wages in the locality in which this tyoe o± labor is performed, for each type of labor needed to execute said contract, and did set forth the prevailing hourly wage scale so ascertained; and 1 111 :THEREAS the City Clerk of the City of Anaheim c'id receive 2 the following sealed proposals prior to 8:00 o'clock P.11. on Novem- 3 ber 19, 1952, in response to said notice inviting sealed proposals 4 5 1 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 28 32 1 29 301 31 for the furnishing of said labor, materials and equipment, to wit: and R. J. Noble Company, P.O. Box 620, Orange, California, for the fur- nishing of all labor, materials and equipment for said street improvement in accordance with the specifications entitled "Speci- fications and Special Provisions for the Improvement of West Vermont Avenue from Lemon Street to Palm Street in the City of Anaheim 27 County Grant from Highway Users Tax Fund, September 1952, Job No. 328" is the lowest responsible proposal submitted for furnishing 1 said labor, materials and equipment and performing all work necess-1 ary for the improvement of West Vermont Avenue from Lemon Street to Palm Street in the City of Anaheim aforesaid, as specified in the notice inviting sealed proposals and in the specifications and l 5575.00 1700 Cu.Yds. 1.59 2703.00 1050 Tons 4.52 4746.00 '47449.00 1 special provisions for said improvement aforesaid, and that said 2 proposal of R. J. Noble Company should be accepted and a contract 3L awarded to said company. 4 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 5 City of Anaheim that the sealed proposal submitted by R. J. Noble 6 Company, P.O. Box 620, Orange, California, for furnishing all labor; 7 materials and equipment for street improvement in accordance with it 8Ithe specifications entitled "Specifications and Special Provisions 9 for the Improvement of West Vermont Avenue from Lemon Street to 10 ;Palm Street in the City of Anaheim, County Grant from Highway Users 13. 1 12 lances thereto as set forth in said specifications and special 13Iprovisions be, and the same is hereby, accepted and that a contract; 14Hfor the furnishing of said labor, materials and equipment in 15laccordance with the notice inviting sealed proposals, the proposal 16 of said R. J. Noble Company and said specifications and special 17 (provisions be, and the same is hereby, awarded to said R. J. Noble Company be, and it is hereby, required to execute a contract in required form satisfactory to the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by it and in accordance with the specifications and special provisions hereinabove referred to and that said R. J. Noble Company shall be required to furnish a surety bond in an amount equal to 100 per cent of the contract price for the furnishing of all said labor, materials and equipment for said street improvement 1 hereinabove referred to, as security for the faithful performance of said contract, and a separate surety bond in an amount equal to 100 per cent of such contract price as security for the payment of all persons performing labor and furnishing materials for said street improvement. 1 2 4 5 6 7 8 10 11 14 15 16 17 18 19 20 21. 22 23 24 25 26 27 28 29 30 31 32 3 11 9 12 13 AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to execute for and on behalf of the City of Anaheim with said R. J. Noble Company a written contract for furnishing all labor, materials and equipment for street improvement in accordance with the specifications entitled "Specifications and Special Pro- visions for the Improvement of West Vermont Avenue from Lemon Street' to Palm Street in the City of Anaheim, County Grant from Highway Users Tax Fund, September 1952, Job No. 328 together with the appurtenances thereto as set forth in said specifications and special provisions, the notice inviting sealed proposals, the pro- posal submitted by said contractor and the terms and provisions of this resolution. AND BE IT FURTHER RESOLVED that said contract shall contain a provision that should said contractor fail to do or perform the work as herein provided in the manner herein set forth in a good and workmanlike manner, they shall, in addition to any other penal- ties provided in the contract documents, be liable to the City of I Anaheim for all loss or damage that the latter may suffer on accoun thereof and that said improvement be completed within thirty (30) days from the date of the contract made and entered into with said contractor.
