RESOLUTION NO. 3083

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM EXCLUDING CERTAIN TERRI-
TORY FROM WEST ANAHEIM ANNEXATION NO.2,
CONSTITUTING LESS THAN FIVE PER CENT OF
THE TOTAL AREA THEREOF.
WHEREAS, the City Council of the City of Anaheim
did on the 22nd day of November, 1955 reoeive a written
petition asking that certain new territory desoribed in said
petition be annexed to the City of Anaheim, which said.terri-
tory was thereafter designated "West Anaheim Annexation
No.2"; and
WHEREAS, on said date the City Counoil of the City
of Anaheim did adopt Resolution No. 3015 deolaring its in-
tention to call a special election, and did fix the 27th day
of Deoember, 1955 at 7:00 o'clock P.M., as the day, hour and
plaoe when and where any person owning real property within
said territory oould appear before the legislative body of
the City of Anaheim and show cause why such territory should
not be annexed to the City; and
WHEREAS, said City Council did hold and oonduot
said public hearing on the 27th day of December, 1955, and
did find and determine that the protests were insufficient
to prevent further prooeedings in said matter, and did
thereupon oontinue the hearing upon protests for an addi-
tional ten days, to wit, to the 10th day of January, 1956,
to allow the filing of additional protests against said
annexation; and
WHEREAS, on the 10th day of January, 1956, the
City Counoil did hold and conduot a further hearing upon
protests in said matter, and did find and determine that
protests were not made by the owners of one-halt of the
value of the territory proposed to be annexed; and
WHEREAS, on said date, to wit, January 10, 1956,
the City Council did receive a request from Park Village
Homes for the exclusion from the territory proposed to be
annexed in said West Anaheim Annexation No.2 of the fol-
lowing described property:

Beginnin~ at the intersection of a line parallel
to and 15.00 feet northerly as measured at right
angles to the southerly line of the NEt of
Section 12, T4S, RIlW, S.B.B. &M. (said southerly
line also being the center line of Crescent
Avenue) and the westerly line of the Ei of the
SEt of the NEi- of said Section 12, said point
also being an angle point in the existing Anaheim
City Limits Line as established by the Magnolia
Crescent Annexation to the City of Anaheim,
Annexation No. 52t as passed by Ordinanoe No.
956 on December 2~, 1954 and filed with the
Secretary of State on January 31, 1955; thenoe

929.02 feet more or less to the point of
beginning.
AND WHEREAS, the City Counoil finds that the area
of the above desoribed parcel of property is approximately
20.16 aores and oonstitutes less than five (5) per cent of
the total area of the territory proposed to be annexed in
the West Anaheim Annexation No.2; and the City Counoil does
further find that no good reason exists why said territory
should not be excluded, and that unless said property is
excluded from said proposed annexation, the owner thereof
will be delayed in the development of said property, and
will suffer substantial loss and damage.
NOW, THEREFORE, BE IT RESOLVED by the City Counoil
of the City of Anaheim that the territory hereinabove men-
tioned and described be, and the same is hereby, exoluded
from the territory designated and described as the West
Anaheim Annexation No.2, and from all subsequent prooeedings
in said matter.
