56R-3063 ,- - RESOLUTION NO. 3063 r , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA8~n1 ACCEPTING THE OFFER OF C & J CONSTRUCTION COMPANY, A COPARTNER- SHIP, TO FLiR'ISH ALL Li~30R TO INSTALL PRD1ARY AND SECONDARY ELECTRICAL DISTRIBU- TION FACILITIES IN TRACTS NOS. 2155 AND 2537, WORK ORDERS NOS. 2215 AND 2211, RESPECTIVELY; AND AUTHORIZING THE EXECU- TION OF AN AGREEMENT TO BE MADE AND ENTERED INTO WITH SAID C & J CONSTRUCTION COMPANY. WHEREAS, the City Council does find and determine that public convenience and necessity require the installation of primary and secondary electrical distribution facilities, consisting of pole lines, cross-arms, secondary racks, insu- lators, transformers, fuse cut-outs, etc., in Tract 2155, Work Order No. 2215, and Tract 2537, Work Order No. 2211; and \iHEREAS, C & J Construction Company, a copartner- ship, has offered to furnish all labor to install said primary and secondary electrical distribution facilities in accordance .<lith the design, plans, profiles, drawings and/or specifica- tions prepared by the Superintendent of the Light, Power and Water Department of the City of Anaheim, and to install the same wi thin forty-five (L~5) working days from and after notice of acceptance of its offer, for the price of $4,180.00; and WHEREAS, the City Council finds that said price is the lowest obtainable for the furnishing of all labor to in- stall said electrical distribution faci 11 ties, and that the offer of C & J Construction Company should be accepted upon the conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of C & J Construction Company, a copartnel'ship, to furnish all labor to install primary and secondary electrical distribution facilities, oon- sistinis of pole lines, cross-arms, secondary raoks, insulators, transformers, fuse cut-outs, etc., in Tract 2155, Work Order No. 2215, and Tract 2537, Work Order No. 2211, in accordance "Hi th the design, plans, profiles, drawings and/or specifica- tions prepared by the Superintendent of the Light, Power and Water Department of the City of Anaheim, be, and the 'same is hereby, accepted, llpon the fo 110lving condi tions: 1. That the furnishing of all labor an d the in- stallation of said electrical distribution facilities shall be completed within forty- five (45) Horking days from and after receipt of notice from the City of Anaheim of the acceptance of said offer. r 2. That in the fU:l:'Dishing of all labor for the installation of said electrical distribution facilities it shall be expressly understood and agreed that said C & J Construction Com- pany is acting as an independent contractor and not as an agent, servant or employee of the City of Anaheim. -1- r r Jl! -- -- AND BE IT FURTHER RESOLVED that the purchase price for the furnishing of all af said labor for the installation and campletion af said pJblic improvement above described shall be paid to' the said C & J Constructian Campany as fol- Im.s : 85% thereof upan the campletion and aoceptanoe of said improvement, and the remaining 15% thereO'f thirty (30) days after the filing of notice of completion of said improvement. BE IT FtJHTHER RESOLVED that said C & J Construotion Company shall carry public liabilitt and property damage in- surance in an amaunt not less than $100,000.00 for injuries, including accidental death, for any ane persan, and subjeot to the same limit for each persan in an amount not less than $300,000.00 on account of any ane accident, and property damage insurance in an amaunt not less than $50,000.00; and shall take out and maintain during the life af said contraot warkmen's compensatian insurance cavering all of its employees an the project; and public liability and property damage in- surance to' caver vehicles used or' maintained by it in the performance of said work connected with said impravement, with liability limits of not less than $50,000.00 for anyone persan, and $100,000.00 for anyone accident, and property damage of $10,000.00. That said C & J Construction Campany shall also fur- nish a faithful performance bond and a labor and material band for 100% of the cost of said public improvement. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to' enter intO' a cantract with said C & J Construction Company, a oapartner- ship, in the usual form approved by the City Attorney, upon the terms and conditions herein speoified and the terms con- tained in the standard form 0'1' contract af the City of Anaheim for public improvements.
