R:3, the City Planning Commission of the City of Anaheim did receive a petition from the property owner gmlipx of certain real property situated in the City of Anaheim, County of Orane;e State of California, described as follows: The Ni of the E-- of Lot 9, Anaheim Extension, known as 1522 1540 East Center Street, requesting permission to divide the frontage lying along East Center Street into three (3) parcels, 60 feet by 150 feet; 76.56 feet by 150 feet; and 130 feet by 150 feet. The 76.56-foot lot would contain an existing Single Family Dwelling. The owner is Mrs. Lena Bastian, 1528 East Center Street, and the property is presently zoned R-A, Residential-Agricultural. R:TAS, the City Planning Commission did hold a public hear- ing at the City Hall in the City of Anaheim upon said petition on November 3, 1952 notices of rhich said public hearing were duly given as reeuired by law and the orovisions of Section 5200.17 of the Anaheim Municipal Coda; and 'JHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consider- ation of all evidence and reports offered at said hearing, did adopt its Resolution Yo. 19 recommending to the City Council of the City of Anaheim that Variance Yo. 175 be granted upon the conditions stated in said resolution; and ':!HERTAS the City Council does find that: 1. There are exceptions or extraordinary circumstanees or conditions applicable to tha property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be :Materially detrimental to the public welfare or injurious to the property or inprovements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely aff ct the comprehensive general zoning plan. NC7 TLIEREFOR. EE 2T RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hreby ,.;ranted to Mrs. Lena Bastian, 1528 East Center Street for the use of said property for the following nurooscs: To divide the Center Street frontage into three (3) parcels, containing frontages as follows:— 60 feet, 76.56 feet, and 130 feet. The City Council hereby reserves the ri;-;ht to revoke such variance permit for good cause or failure of said owner_ or their heirs, successors or assigns to comply with the Anaheim L unicipa1 Cocle and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim lrunicinal Code unless otherwise specified herein.
