WHEREAS, the City Council of the City of Anaheim diet on the day of October 19 52, receive a written petition asking WHEREAS, on the 21st day of October 19 52, the City Council of the City of Anaheim did adopt its Resolution ITo. 2024 declaring its intention to call a special election, and did fix a time and place for the hearing of _arotests, and give notice of such hearing, and did find and determine that the proponents who filed said petition for the annexation on the 21st day of October 19 52, had done and performed the things required to be done and performed by tho Annexation Act of 1913 (Title IV, Division Part 2, Chapter 1, Art icles 1 to 4 inclusive) and did further find that all of the provis- ions of said Annexation Act of 1913, as amended, required to be complied with before the adoption of said resolution, had been com- plied with prior to the adoption of said resolution, which resolution 'ras duly published as required by law, and WHEREAS, said City Council did, pursuant to its Resolution 1;o. 2024, hold a public meeting and hearing on the 7th day of November 19 52, at tho hour of 8:00 o'clock P.ii. in the City Council Chamber of the City Hall of the City of Anaheim, the date fixed in said resolu- tion as the day, hour and place when and where any and all persons owning real property within the boundaries of the territory so pro posed to be annexed and having any objections to the proposed annexa- tion, night appear before the City Council of the City of Anaheim and show cause why such territory should not be so annexed, which said :resolution 1 ?0. 2024 did notify all persons having any objections to such pro annexation to appear on said date at said hour and place to show cause, if any they had, why such territory should not be annexed, and further notifying such persons that any ;protests against the calling of an election to submit to the electors residing within said territory the question of annexation to the City of Anaheim, and any protests against the annexation of said territory to th City of Anaheim must be in writing and filed with the City Clerk of the City of Anaheim not later than the hour and data set forth in such resolu- tion for the hearing of objections to said election and the annexation -2- of said territory to the City of Anaheim, which said resolution was duly published once a week for two successive weeks prior to the date fixed for the hearing of protests and objections to said election and annexation of said territory to the City of :Anaheim, in the Anaheim 3ulletin, a newspaper of general circulation published and circulated in the City of Anaheim, County of Orange, State of California; and WHEREAS, at said public heaxin`; held on the 7th day of Novem- ber 1952 the City Council of the City of Anaheim did hold a hearing to hear all written protests theretofore filed objecting to the calling of said special election or the annexation of said terri- tory hereinafter described to the City of Anaheim, and the City Council does hereby find that written protests were not ,jade by the owners of a majority of the separate parcels of property within the territory proposed to be annexed; The new territory in which such special election is hereby called and shall be held, is situated in the County of Orange, State of California, the boundaries of which are described as follows: A tract of land lying within fractional sections 4, 5, 6 and sections 8 and 9, Township 4 South, Range 10 West, San Bernardino, Base and Meridian, and fractional section 1, Township 4 South, Range 11 West, San Bernar- dino, Base and Meridian, more particularly described as follows: Beginning at a point on the west City Limits Line of the City of Anaheim which point is also the Southeast Corner of La Palma Avenue and Euclid Avenue; thence northerly along said West City Limits Line which line is also the East right of -way line of Euclid Avenue, 270 feet to a point; thence westerly on a line parallel to the center line of La Palma Avenue and 240 feet northerly thereof measured perpendicu- larly, a distance of 3,694 feet, more or less, to a point on the east property line of that parcel of land described as the West 10 acres of the SE4 of the SW4 of Section 5, Township 4 South, Range 10 West; thence northerly along said east property line 1,095 feet, more or less, to the Northeast corner of said parcel which corner is also the Southeast corner of that parcel of land described as the West 10.16 acres of the NE4 of the SW4 of said Section 5; thence continuing along the East property line of said West 10.16 acres and said property line extended, a distance of 1,364 feet, more or less to a point on the North right of -way line of Houston Street; thence westerly along the north right -of -way line of Houston Street a distance of 1,690 feet, more or less to a point on the West right -of- way line of Brookhurst Street; thence southerly along the West right -of -way line of Brookhurst Street 40 feet, more or less, to the northwest corner of Brookhurst Street and Houston Street; thence southerly along the said easterly right -of -way line of Magnolia Avenue to the North right -of -way line of La Palma Avenue; thence easterly 210 feet along the North right -of -way line of said La Palma Avenue to a point; thence northerly along a line parallel to and measured 210 feet at right angles thereto to its intersection with the southwesterly right of -way line of the Southern Pacific Railroad Company thence southeasterly along said southwesterly right -of -way line of the Southern Pacific Railroad Company a distance of 260 feet to a point; thence northeasterly 225 feet more or less to a point of intersection of the northeasterly right -of -way line of Manchester Avenue and a line parallel to and measured 210 feet southerly at right angles to the southerly right -of- way line of Houston Street; thence easterly along said line which is parallel to and 210 feet southerly of the southerly right -of -way line of said Houston Street a distance of 4,760 feet more or less, to the easterly right -of -way line of Brookhurst Street; thence northerly along said easterly right -of -way line of Brookhurst Street a distance of 40 feet more or less, to a point 210 feet southerly of and measured at right angles to the southerly right -of -way line of Houston Street; thence easterly along said line which is parallel to and 210 feet southerly of the said southerly right -of -way line of Houston Street a distance of 1300 feet more or less, to a point on the West property line of the West 10.16 acres of the NE4 of the Ski of Section 5, Township 4 South, Range 10 West; thence southerly along said West property line 1,114 feet, more or less, to the southwest corner of said property, which corner is also the northwest corner of the west 10 acres of the SE4 of the SW4 of said Section 5; thence continuing 1,365 feet more or less, along the West property line of the said West 10 acres and said line extended to a point on the South right -of -way line of La Palma Avenue; thence easterly along the said south right -of -way line of La Palma Avenue a distance of 4,030 feet, more or less to the point of beginning. That said new territory hereinbefore and in said petition for annexation described is hereby designated as "HOUSTON AVENUE AiTTEXATIOTTtt and said territory shall be indicated and rofrrod to by the nape of "HOUSTON AVENUE ANNEXATION" upon the ballots to be used at said special election, at which the question of such anne .tion of said territory to the City of Anaheim is submitted to the electors of said territory, and the name "HOUSTON AVENUE ANNEXA- TION" whenever used in the notice of said special election hereby called in said territory, and any and all proceedings for the annexation of said territory to the City of Anaheim shall mean and shall be construed to moan the territory hereinbefore and in said pc- tLion described, and so proposed by said petition to be annexed to said City of Anaheim. Such notice shall distinctly designate said territory proposed to be annexed to said City of Anahoim as HOUSTON AVENUE ANNEXATION as the name by which such territory shall bo indicated upon the election ballots; that such notice shall instruct tho electors how to vot at said special election; that with respect to the assumption of bonded indebtedness said notice shall: 1. State distinctly the proposition to be submitted. 2. Specify the improvement or improvements for which the indebtedness was incurred or authorized. 3. State the amount or amounts of such indebtedness outstanding at the date of the first publication of the notice. 4. State the amount authorized to be represented by bonds to be issued. 5. State the ma;:imum rate of interest payable or to be payable on the indebtedness.
