ANAHEIM, CALIFORNIA RESOLUTION NO. 2036 31 4 6 7 8 91 10 11' WHEREAS, the public interest and necessity require the l 12 construction and completion of a public improvement in the City of 13 Anaheim, to wit: The West South Street improvement consisting of A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT PUBLIC INTEREST AND NECESSITY RE- QUIRE THE CONSTRUCTION AND COMPLETION OF A PUBLIC IMPROVEMENT, TO WIT: THE PAVING OF WEST SOUTH STREET FROM LOS ANGELES TO LEMON STREET AND FROM PALM STREET TO MANCHESTER AND APPROVING THE DESIGN, PLANS, SPECIFICATIONS AND DRAWINGS FOR THE CONSTRUCTION THEREOF; AUTHORIZING THE CONSTRUCTION OF SAID PUBLIC IMPROVEMENT IN ACCORDANCE WITH SAID PLANS AND SPECIFICATIONS AND AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH A NOTICE INVITING SEALED PROPOSALS FOR THE CONSTRUCTION THEREOF. the paving of West South Street from Los Angeles to Lemon Street and from Palm Street to Manchester Avenue in accordance with the plans and specifications prepared'by the City Engineer, and WHEREAS, the City Council has instructed the City Engineer to prepare detailed designs, plans and specifications for the construction of said public improvement, and WHEREAS, the City Engineer has prepared said plans and 211 specifications for the construction of said public improvement 22 and has submitted the same to the City Council, and 23 WHEREAS, the City Council finds that the design and specifi- 24 cations for the paving of said West South Street and West South 251 Street public improvement are in accordance with good engineering 26 l practice and are adequate to serve the needs and the requirements 27 1 of the City of Anaheim and the citizens and residents in said area 281 for the purposes for which it is intended, and that the plans and 29 specifications are adequate for the construction of said public 301 improvement and that such design, plans and specifications should 31 1 be approved, and 32 2 3 13 14 15 1 16 17 18 19 20 21 22 23 24 25 26 27 28 CITY OF ANAHEIM 204 E. CALIFORNIA 1 WHEREAS, the City Council finds that said West South Street is a street of major importance and that said public improvement shall be constructed and paid for out of the one quarter (q) cent 4 gas tax fund and that it shall be known as State Project No. 38 5 for the improvement of streets of major importance. 6! NOW, THEREFORE, BE IT RESOLVED by the City Council of the 7 City of Anaheim that the detailed design and detailed plans, pro 8 files, drawings and specifications for the construction of said 9 public improvement be, and the same are, hereby approved and adopt 10 ed as prepared by the City Engineer and submitted to the City 11 Council. 1 2 AND BE IT FURTHER RESOLVED that said public improvement be constructed in accordance with said design, plans, profiles, drawings and specifications. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and he is hereby, authorized and directed to publish a notice, according to law, inviting sealed proposals for the furnishing of all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner and in strict accordance with said detailed design, detailed plans and specifications the public improvement hereinabove mentioned and described and fixing the 19th day of November, 1952, at the hour of 8:00 o'clock P.M. as the date and hour for the opening of said bids at the City Council Chamber in the City Hall in the City of Anaheim, and that said notice shall be published at least twice; the first publication of which shall be at least 10 days prior to the date fixed for the 29 l l opening of said bids, and that said publication shall be at least 301 5 days apart. 31 1 AND BE IT FURTHER RESOLVED that the successful bidder or 32 bidders shall be required to enter into a contract with the City -2- CITY OF ANAHEIM 204 E. Each proposal must be accompanied by an unconditional certified or cashiers check drawn on a solvent state or national bank doing business in the State of California, or by a bid bond with corporate surety which is now qualified with the County Clerk of Orange County, California, such check or bond to be made payable to the City of Anaheim in an amount not less than ten percent of the estimated aggregate payments to be made under the contract, as a guaranty that the bidder will, if awarded the work in accordance with the terms of the pro- posal, execute a contract in the required form and furnish surety bonds satis- factory to the City for the faithful performance of the contract and for the pay- ment of claims of material -men and laborers thereunder. The faithful performance bond and the bond to material -men and laborers shall each be not less than one hundred percent (100 of the estimated aggregate payments to be made under the contract. No proposal will be accepted from a contractor who is not licensed in accordance with the provisions of Chapter 9 of Division III of the Business and Professions Code of the State of California. Plans and specifications may be obtained at the office of the City Engineer upon a deposit of $25.00, which deposit will be refunded upon the return of such documents in good order within 5 days after the award of the contract. Proposals must be submitted on blank forms furnished by the City Engineer. The City Council of said City reserves the right to reject any or all proposals, to waive any informality in any proposal and to reject the pro- posal of any person whom it, in its sole discretion, does not deem responsible.
