CITY COUNCIL OF THE CITY O lTAH FINALLY ACCEPTING THE WORK AND COMPLETION OF MANHOLES 1 AND J AND THE REPAIR WORK ON 24 JOINTS OF K.-INCH CLAY PIPE IN UNIT III OF THE MAGNOLIA TRUNK SEWER AND PUMPING PLANT AND FORCE MAIN OF THE ORANGE COUNTY JOINT OUTFALL SEWER. 5 WHEREAS, a contract was heretofore made and entered into 6 on the 28th day of January, 1951, by and between the City of Anaheim, 7 a municipal corporation, as contracting agent for the Cities of 8 Anaheim, Fullerton and Orange, and for the Buena Park, Garden Grove, 9 L a Habra and Placentia Sanitary Districts, pursuant to resolutions 10 theretofore passed and adopted by said Cities and Sanitary Districts 11 and Charles T. Brown, doing business as Charles T. Brown Company, and 12 Paul Vukich, Jr., doing business as Paul Vukich Construction Company, 131a joint venture, for the construction and completion of Unit III of 14 the Magnolia Trunk Sewer and Pumping Plant and Force Main and Project 15 together with the appurtenances thereto of the Orange County Joint 16 Outfall Sewer, all in accordance with said contract and other con- 171 tract documents; and 181 WHEREAS, said contractors have heretofore completed all of 19 the work and furnished all the materials necessary and required for 20 the construction and completion of said Unit III of Magnolia Trunk 21 Sewer and Pumping Plant and Force Main, except that portion of 22 Manhole I, Bid Item No. 37, shown as Valve Box 13, and the connecting 23 1611 x 16" x 12" C.I. all Bell YtBranch, together with the necessary 24 cast iron pipe, concrete thrust blocks, labor and equipment to make 25 said Manhole I complete and in accordance with the plans and speci- 26 fications and also the construction of Manhole J, Bid Item No. 38, 27 which work and completion of said Unit III, except the above, has 28 heretofore been duly accepted by said Cities and. Sanitary Districts; 29 an d 30 WHEREAS, since the date of acceptance of all other work 31 and the completion of said Unit III, said contractors have completed 32,that portion of Manhole I, Bid Item No. 37, shown as Valve Box B, Hand the connecting 18" x 13" x 12" 0.1. all Bell Y-Branch, together -1- 11 with the necessary cast iron pipe, concrete thrust blocks, labor and 2 equipment to make said Manhole 1 complete and in accordance with the 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 plans and specifications and also the construction of Manhole J, Bid Item No. 38, and have notified the Chief Engineer of said Cities and Sanitary Districts of such completion; and WHEREAS, the acceptance of the work and completion of all other portions of said Unit 111 was made upon the express understand- ing and condition that said contractors would repair and/or re-olace, at their own cost, any joints of clay pipe in any portion of said Unit 111 which had not theretofore been Jacketed or encased which developed cracks within a period of thirty days from date of final acceptance of said work, and that such repair and/or replacement work would be done to the satisfaction and approval of the Chief Engineer of said. Cities and Sanitary Districts; that said acceptance was made on the 7t1: day of January, 1952; and WHEREAS, within said period of thirty days from and after the 7th day of January, 1952, twenty-four (24) joints of said 39 inch vitrified clay pipe were found to have cracks therein, in varying size and loncth, and all such cracked joints of pipe have been re- Paired and/or replaced in a manner specified in said resolutions of acceptance and to the satisfaction and approval of the Chief Engineer of said Cities and Sanitary Districts; and. WHEREAS, Nat. H. 7eff, Chief Engineer of said Cities and Sanitary Districts, filed with the City Clerk of the City of Anaheim on the 13th day of March, 1952, his certificate in writing certify- ing that said contractors have completed, in accordance with the plans and specifications adopted by Resolution No. 1800 of the City Council of the City of Anaheim, as amended by Resolution. No. 1902, passed on December 26, 1951, the balance of the construction of 30j Eanhole 1, Bid Item Yo. 37, shown as Valve Box B, and the connecting 31 16" x 13 x 12" C.I. all Bell Y-Branch, together with the necessary 32cast iron pipe, concrete thrust blocks, labor and equipment to make -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 g, Bid item No. 38, of the 21 22 23 Vukich, doing business as Paul Vukich Construction Company, a joint 24 v be, and the same is herebn accepted, and 25 BE IT FURTHER RESOLVED that upon the expiration of thirty- 26 27 28 29 30 32 said Manhole I complete, in accordance with said plans and specifi- cations and also the construction of Manhole J, Bid. Item No. 38, of Unit III of said Magnolia Trunk Sewer and Punning Plant and Force Main, and has certified that the total and final amount due said contractors is the sum of 0678.37; and WHEREAS, the City Council of the City of Anaheim finds and determines that said contractors have completed the balance of said Unit III in accordance with the provisions of the contract and con- tract documents and that said work should be finally accepted and a notice of completion filed, and the payment of the balance due said contractors be authorized in accordance with the contract documents and the terms and conditions set forth in this resolution. NOW, THEREFORE, BE IT Rn;SOLVED by the City Council of the City of Anaheim that all. of the work, labor and materials and the completion of that portion of Manhole I, Bid Item No. 37, shown as Valve Box 3, and tne connecting 13" x together with the necessary cast iron pine, concrete trust blocks, labor and enuipment to make said Manhole 1 complete and in accordance ith the plans and specifications and also the construction af Manhole ng Plant and 2orce Main, harles Orange County Joint Outfali Sewer and Pump- togetnier with the appurtenances thereto, by T. Brown, doing business as Charles T. Brown Company, and Paul five (35) days from date of acceptance, that said contractors be paid the balance due them, in accordance with the contract documents, for he construction, installation and completion-of the balance of said nit III hereinbefore mentioned and described, in accordance with the lans and specifications of contract documents and the resolutions of 31cceptance oi tne other portions of said Unit III passed and adopted by said Cities and Sanitary Districts; and 13" x C.I. all Bell 7-Branch, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 BE IT FURTHER RESOLVED that the City of Anaheim, as con- tracting agent for said Cities and Sanitary Districts, file a. notice of completion of said work and that the Mayor and City Clerk of the City of Anaheim be, and trey are hereby authorized and directed to file such notice of completion as provided by law, within fifteen (15) days from the date of acceptance of the completion of the balance of the work on said Unit III and the repair work on said twenty-four (24) joints of pipe.
