CALIFORNIA described 24' 25 26 and 27! boundaries 28 29 30 31 321! of the are inhabited, and RESOLUTION NO. 19'33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CALLING A SPECIAL ELECTION ON THE 22ND DAY OF APRIL, 1952, IN CERTAIN TERRITORY IN THE COUNTY OF ORANGE AND CONTIGUOUS TO THE CITY OF ANAHEIM, PROPOSED TO BE ANNEXED TO SAID CITY OF ANAHEIM, PROVIDING FOR THE HOLDING OF SUCH ELECTION AND SUBMITTING TO THE ELECTORS RESIDING IN SUCH TERRITORY THE QUESTION WHETHER SUCH TERRITORY SHALL BE ANNEXED TO, INCORPORATED IN, AND MADE A PART OF SAID CITY OF ANAHEIM, AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAX— ATION EQUALLY WITH PROPERTY WITHIN THE CITY OF ANAHEIM, TO PAY ITS PRO RATA PORTION, BASED UPON ASSESSED VALUA— TION, OF ALL THE BONDED INDEBTEDNESS OF SAID CITY OF ANAHEIM, OUTSTANDING ON THE 13th DAY OF NOVEMBER, 1951, OR THERETOFORE AUTHORIZED; DESCRIBING SAID TERRITORY AND DESIGNATING IT BY THE NALIE OF "EUCLID AVENUE ANNEX— ATION NO. 2", ESTABLISHING AN ELECTION PRECINCT AND POLLING PLACE IN SAID TERRITORY, APPOINTING THE OFFICERS OF ELECTION FOR SAID SPECIAL ELECTION AND PROVIDING FOR THE PUBLICATION OF NOTICE OF SUCH ELECTION. WHEREAS, the City Council of the 13th day of February, 1952, receive a written petition asking that certain new territory described in said petition be annexed to the City of Anaheim, and WHEREAS, said territory so oroposed to be annexed to said City of Anaheim is situated in the County of Orange, State of Calif— ornia, and is contiguous to the City of Anaheim and said petition contains a description of said territory in words and figures as hereinafter in this resolution described, and WHEREAS, said petition is signed by not less than one—fourth of the qualified electors residing within the territory hereinafter as shown by the County Registration of Voters, and WHEREAS, said new territory proposed to be annexed to said City of Anaheim does not form a Dart of any municipal corporation more than twelve (12) Qualified electors resided within the of the territory proposed to be annexed at the time of the filing of said petition for said annexation, and said electors bona fide residents of said new territory and said territory is WHEREAS, on the 13th day of February, 1952, the City Council City of Anaheim did adopt its Resolution No. 1925 declaring City of Anaheim did, on the 3. ANAHEIM, CALIFORNIA j its intention to call a special election and did fix a time and 2 place for the hearing of protests, and gave notice of such hearing, 3 and did find and determine that the proponents who filed said peti- 4 tion for annexation on the 13th day of November, 1951, had done and 5 performed the things required to be done and performed by the 6 Annexation Act of 1913 (Title IV, Division 2, Part 2, Chapter 1, 7 Articles 1 to 4 inclusive) and did further find that all of the 8 provisions of said Annexation Act of 1913, as amended, required to 9 be complied with before the adoption of said resolution, had been 10 Icomplied with prior to the adoption of said resolution, which reso- 11 ilution was duly published as required by law, and 12 1 13 14 15 16 17 18 19 20 WHEREAS, said City Council did, pursuant to its Resolution No. 1925, hold a public meeting and hearing on the 11th day of March, 1952, at the hour of 8 :00 o'clock P.M. in the City Council Chamber of the City Hall of the City of Anaheim, the date fixed in said resolution as the day, hour and place when and where any and all persons owning real property within the boundaries of the terri tory so proposed to be annexed and having any objections to the proposed annexation, might appear before the City Council of the City of Anaheim and show cause why such territory should not be so 21 ',!annexed, which said Resolution No. 1925 did notify all persons 22 having any objections to such proposed annexation to appear on said 23 date at said hour and place to show cause, if any they had, why sucl: 24 !territory should not be annexed, and further notifying such persons 25 that any protests against the calling of an election to submit to 26 the electors residing within said territory the question of annexa- 27 tion to the City of Anaheim, and any protests against the annexation 28 lof said territory to the City of Anaheim must be in writing and 29 filed with the City Clerk of the City of Anaheim not later than the 30 ;hour and date set forth in such resolution for the hearin6 of 31 !objections to said election and the annexation of said territory to 32 the City of Anaheim, which said resolution was duly published once 7 CITY OF ANAHEIM 204 E. CALIFORNIA 1 "a week for two successive weeks prior to the date fixed for the 2'hearing of protests and objections to said election and annexation 3 of said territory to the City of Anaheim, in the Anaheim Bulletin, 411a newspaper of general circulation published and circulated in the 5City of Anaheim, County of Orange, State of California, and H 6 WHEREAS, at said public hearing held on the llth day of 7 1952, the City Council of the City of Anaheim did hold a 8 1hearing to hear all written protests theretofore filed objecting to 9 the calling of said special election or the annexation of said ter- 10lritory hereinafter described to the City of Anaheim, and the City i 11 ICouncil does hereby find that written, protests were not made by the 1 12 owners of a majority of the separate parcels of property within the 13 14 15 16 17 1 Anaheim and giving notice thereof as required by law, and to submit 18' to the electors residing within said territory the question whether 191 said new territory shall be annexed to, incorporated in, and made 201 a part of the City of Anaheim, and said petition also contains a 21 1 request that the question to be submitted at such special election 221 to the electors residing within said new territory shall be whether 23 said new territory shall be annexed, Incorporated in, and made a 24' part of said City of Anaheim, and the property therein be, after 25 such annexation, subject to taxation equally with the property 26 within said City of Anaheim, to pay its pro rata share based upon 271 assessed valuation of all bonded indebtedness of said City of Ana 28 beim outstanding or authorized at the date of the filing of said 291 petition, to -wit, November 13th, 1951. 30 I NOS, THEREFORE, BE IT RESOLVED by the City Council of the 31L City of Anaheim that a special election be, and the same is hereby, 32 lc alled to be held on Tuesday, the 22nd day of April, 1952, in said territory proposed to be annexed, and WHEREAS, said petition contains a request that the City Council of the City of Anaheim call a special election to be held in said territory thereby proposed to be annexed to said City of 1 2 3 12 13 14 15 16 17 18 19 20 2.1 22 23 24 25 26 27 28 301 31 32 CITY OF ANAHEIM 204 E. ANAHEIM, CALIFORNIA new territory mentioned in the petition aforesaid and hereinafter more particularly described, and proposed to be annexed to the City of Anaheim, for the purpose of submitting to the electors residing 4 in said new territory the question whether the said new territory 5 shall be annexed to, incorporated in, and made a part of said City 6 of Anaheim and the property therein be, after such annexation, sub 7 ject to taxation equally with the property within said City of 8 Anaheim, to pay its pro rata share, based upon assessed valuation, 9 of all the bonded indebtedness of said City of Anaheim outstanding 10 on November 13, 1951, or theretofore authorized. 11 The new territory in which such special election is hereby called and shall be held is situated in the County of Orange, State of California, the boundaries of which are described as follows: A tract of land including a portion of the SW* of the SW* of Section 9, a portion of the SE* of the SEA, of Section 8, a portion of the NW* of the iTW* of Section 16, and a portion of the NE* of the NEB of Section 17, Township 4 South, Range 10 West, San Bernardino Base and Meridian, and Lots 1, 2, 3, 4 and 5 of Tract 658, as shown on a map thereof recorded in Book 20, Page 36, Miscellaneous Maps, so including a portion of Lincoln Avenue and Euclid Avenue, in the County of Orange, State of California, and more particularly described as follows: Beginning at a point on the present westerly city limit line, said point being on the southerly line of Lincoln Avenue and 346.0 feet westerly from the center line of Loara Street; thence N- 1 02' -45 -W along the present city limit line a distance of 310.38 feet to a point; thence N- 57 13 30 -SW along the present city limit lime a distance of 1125.44 feet to a point on the easterly line of Euclid Avenue; thence S- 0 43' -28 -W along the present city limit line a distance of 244.41 feet to a point of intersection with the South line of the N* of the SE* of the SE* of Section 8, Township 4 South, Range 10 West, San Bernardino Base and Meridian projected eastwardly; thence Westwardly along said South line of the N of the SE* of the SE* of Section 8 and said line projected to the westerly line of the SE* of the SE4 of the SE* of said Section 8; thence Southwardly along the Westerly line of said SE* of the SE,* of the SE* of said Section 8, Township 4 South, Range 10 West, San Bernardino Base and Meridian and along the .Westerly line of Lot 5 of Tract 658 as shown on a map thereof recorded in Book 20, Page 38, Miscellaneous Maps, Records of Orange County and said line extended a distance of 689.91 feet, more or less, to the southerly line of Lincoln Avenue; thence Eastwardly along the Southerly line of said Lincoln Avenue to the point of beginning. -4- 10 11 12 13 14 15 16 17 18 19 ANNEXATION NO. 2" and said territory shall be indicated and referred 20 to by the name of "EUCLID AVENUE ANNEXATION NO. 2" upon the ballots 21 to be used at said special election, at which the question of such 22 annexation of said territory to the City of Anaheim is submitted to 23 24 TION NO. 2", whenever used in the notice of said special election 25 hereby called in said territory, and any and all proceedings for 26 the annexation of said territory to the City of Anaheim, shall mean 27 and shall be construed to mean the territory hereinbefore and in 28 said petition described and so proposed by said petition to be 29 annexed to said City of Anaheim. 30 CITY OF ANAHEIM 204 E. ANAHEIM, CALIFORNIA 1 AND BE IT FURTHER RESOLVED that the polls for said election 2 shall be opened at.7:00 o'clock A.M. of the day of said election 3 and shall remain open continuously from said time until MO O'cloci 4 P.M. of the same day, when said polls shall be closed, except as 5 provided in Section 5734 of the Elections Code of the State of 6 California. 7 AND BE IT FURTHER RESOLVED that at said special election the 8 question whether said new territory shall be annexed to, incorporat 9 ed in, and made a part of said City of Anaheim, and the property in 31 addition to any other matters required by law, there shall be 32 printed substantially the following: said new territory be, after such annexation, subject to taxation equally with property within the City of Anaheim, to pay its pro rata portion, based upon assessed valuation, of all the bonded in- debtedness of said City of Anaheim outstanding on November 13, 1951 or theretofore authorized, shall be submitted to the electors residing in said new territory so proposed to be annexed to said. A cross placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition or measure. The qualified electors residing in said new territory so proposed to be annexed to said City of Anaheim are hereby directed to vote upon the question of the annexation of said territory to the City of Anaheim and the subjection of said territory, after annexation, to taxation equally with the property within said City of Anaheim, to pay its pro rata portion based upon assessed valua- tion, of all bonded indebtedness of said City of Anaheim outstandi 1 on November 13, 1951, or theretofore authorized, by stamping a 2 cross in the voting square after the word "YES“ on the ballots 3 to be used in said election, or by stamping a cross in the 4 voting square after the word "NO" on such ballots. ANAHEIM, CALIFORNIA AND BE IT FURTHER RESOLVED that the City Clerk of the City special election by causing a notice thereof to be published at least once a week for four (4) successive weeks prior to the 22nd day of April, 1952, in The Placentia Courier a newspaper of general circulation printed and published outside of the City of Anaheim but in the County of Orange, in which the terri- tory so proposed to be annexed to the City of Anaheim is situated. a part of said City of Anaheim the aforesaid territory sought to be annexed and shall specifically describe the boundaries thereof: and that after such annexation, such territory shall be subject to tax ation equally with the property within said City of Anaheim, to such notice shall instruct the electors how to vote at said special election; that with respect to the assumption of bonded indebtednes said notice shall: 1. State distinctly the proposition to be submitted. 2. Specify the improvement or improvements for which the indebtedness was incurred or authorized. 3. State the amount or amounts of such indebtedness out 30 standing at the date of the first publication of the notice. 1 4. In such notice, the qualified electors residing 6 !in said new territory so proposed to be annexed shall be directed 7 to vote upon the question of annexation as hereinabove provided. 8 AND BE IT FURTHER RESOLVED that immediately upon the closing 91 of the Dolls, the election officers for said election precinct here 10' ,inabove designated shall count the ballots, make up, certify, and 11+ ;seal the ballots and tally sheets of the ballots cast, and deliver 12 'them, with the returns, to the City Clerk of the City of Anaheim; 13 hat, at its next regular meeting held at least three days after 14! 15 the election, the City Council shall canvass the returns.
