72R-289 RESOLUTION NO. 72R-289 ,.,..,"""""""', A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 13 20 . WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from GLADYS L. BOREN and WILLIAM T. and ETHELYN W. SAMWAYS, Owners, and SUBURBAN DEVELOPMENT COMPANY, Agent, to establish an 81-unit motel on the following described property: PARCEL 1: All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: That portion of Lots 17 and 18 of Tract No. 498, as shown on a Map recorded in Book 19, page 24 of Miscellaneous Maps, records of Orange County, California. EXCEPTING THEREFROM the property described as follows: Commencing at the intersection of the Westerly line of Lot 23 of said Tract No. 498 with that certain line described in a deed to the State of California, recorded April 9, 1952, in Book 2313, page 103 of Official Records; thence South 10 18' 30" East, 43.49 feet along said West- erly line to the True Point of Beginning. Thence continu- ing South 10 18' 30" East, 74.57 feet to the Southeast corner of said Lot 17. Thence along the South line of Lot 17, North 890 55' 31" West, 84.38 feet; thence North 480 DO' 00" East, 111.25 feet to the True Point of Begin- ning. PARCEL 2: All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: That portion of Lot 23 of Tract No. 498, as shown on a Map recorded in Book 19, page 24 of Miscellaneous Maps, records of Orange County, California, and that portion of the North- west quarter of Section 26, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: '"'~, Beginning at the intersection of the Westerly line of said Lot 23 with that certain line described in a Deed to the State of California, recorded April 9, 1952, in Book 2313, page 103 of Official Records; thence South 10 18' 30" East, 42.49 feet along said Westerly line; thence North 540 OS' 17" East, 28.52 feet to the aforesaid property line of the State of California per Official Records Book 2313, page 103 at a point distant thereon South 420 00' DO" East 36.00 feet from the point of beginning; thence North 420 DO' 00" West, 36.00 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on June 12, 1972, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, said Commission, after due inspection, investiga- tion and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC 72-133, granting Conditional Use Permit No. 1320 subject to certain conditions therein set forth; and MLEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 11th day of July, 1972, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health and safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting said conditional use permit be, and the same is hereby sustained, and that Conditional Use Permit No. 1320 be, and the same is hereby, granted permitting the establishment of an 81-unit motel on the property hereinbefore described, with waivers of the following Anaheim Municipal Code provisions: SECTION 18.40.070(2-a-2) Minimum building setback on a local street across from single-family (10 feet required, 6 feet proposed) . SECTION 18.40.070(2-a-5-a) Minimum building setback from an interior property line (10 feet required, 1 foot pro- posed) . -2- SECTION 18.40.070(3-a) Maximum building height adjacent to an R-A Zone (.5 feet permitted, 28 feet proposed). ...'- SECTION 18.62.090(B-5) Free-standing sign location (14 feet from adjacent property line required, 10 feet from adjacent property line proposed) . That said Conditional Use Permit be granted subject to the follow- ing conditions: 1. That this conditional use permit is granted subject to the completion of Reclassification No. 71-72-52, now pending. 2. That subject property shall be developed substantially in conformance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 and 2 provided, however, that the pool shall be relocated to the north as stipulated to by the Petitioner. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
