72R-287 RESOLUTIOT'l" NO. 7 2R-2 87 .- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2370. ;vHEREAS, after a request for variance by A. B. COX and MARY COX, owners; LOREN J. MEYERS, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2370 was granted, in part, covering the following described property: That portion of the south 5 acres of the southeast one'-quarter of the southeast one-quarter of the north- east one-quarter of Section 17, Township 4 South, Range 10 West, S.B.B. & M., in the city of Anaheim county of Orange, state of California, as described as follows: Beginning at a point on the center line of Euclid Avenue as shown on a map filed in book 27 page 11 of Record of Surveys in the office of said recorder distant thereon north 00 18' 00" west 210.01 feet from its intersection with the center line of Orange Street as shown on said Record of Survey map; thence parallel with said center line of Orange Street south 890 10' 25" west 150.00 feet; thence parallel with said center line of Euclid Avenue north 00 18' 00" west 120 feet to the northerly line of said south 5 acres; thence easterly along said northerly line to said center line of Euclid Avenue; thence along said center line of Euclid Avenue, south 00 18' 00" east 120 feet to the point of beginning. WHEREAS, thereafter within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. -- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby granted permitting the conversion of an existing residence for commercial use on the property herein- before described with waiver of the following sections of the Anaheim Municipal Code: SECTION 18.40.050(a) Parking to be provided to the rear of a residential structure (parking provided in the front setback) -1- SECTION 18.40.070(6-a) 6-foot masonry wall required along the north property line (5-foot wall existing7 no proposal to increase height of existing wall) SECTION 18.62.155(a) Maximum sign area (8 square feet permitted; 120 square feet pro- posed) That said variance be granted subject to the following conditions: 1. That this variance is granted subject to the com- pletion of Reclassification No. 71-72-49. 2. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4, 5 and 6. 3. That subject property shall be developed in accord- ance with Area Development Plan No. 95, Exhibit "B". BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved ~nd signed by me this 11th day of July, 1972.
