72R-266 ~ RESOLUTION NO. 72R-266 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CALLING AND GIVING NOTICE OF A SPECIAL ELECTION PURSUANT TO GOVERNMENT CODE SECTION NO. 35122, RELATING TO KATHRYN-LINDSAY ANNEXAT ION . WHEREAS, heretofore on the 27th day of June, 1972, in connection with KATHRYN-LINDSAY ANNEXATION, a hearing was held in full compliance with Section 35100 et seg. of the Government Code and there was no majority protest against said annexation; and WHEREAS, in its earlier resolution, the City Council expressed its intention to call a special election to submit to the voters residing in the territory proposed to be annexed the question whether or not said new territory shall be annexed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a special election relating to Kathryn- Lindsay Annexation be, and the same is hereby, called to be held on the 5th day of September, 1972, in said new territory, the boundaries of which are described as follows: That certain parcel of land located in the County of Orange, State of California, being a portion of Sections 7, 8 and 18 of Township 4 South, Range 10 West, S.B.B. & M., described as follows: ,~........... Beginning at a point in the existing City limit line of the City of Anaheim, as established by the Broadway-La Palma Annexation to the City of Anaheim, said" point of beginning being in the northeast corner of Tract No. 2587, as shown on a map recorded in Book 80, page 41, Miscellaneous Maps, records of said Orange County; thence following along the said existing City limit line the following courses and dis- tances: South 00 16' 10" East, 1,110.50 feet; North 890 31' 00" West, 396.00 feet to the beginning of a tangent curve concave northeasterly and having a radius of 50 feet; thence Westerly, Northwesterly and Northerly along said curve through a central angle of 1310 24' 35" an arc distance of 114.68 feet to the beginning of a reverse curve concave northwesterly and having a radius of 50 feet, a radial line bearing South 480 06' 25" East passes through the point of beginning of said reverse curve; thence Northeasterly and Northerly along said reverse curve through a central angle of 410 24' 35" an arc distance of 36.14 feet to an inter- section with a line parallel with and 25 feet westerly of the centerline of Bircher Street, as said Bircher Street is indicated in Tract No. 1851, as shown on a map recorded in Book 56, page 26, Miscellaneous Maps, records of said Orange County; thence North 00 16' lO" West, 6.10 feet along said parallel line to an intersection with the southerly line of Lot 9 in said Tract No. 1851; thence North 890 31' 00" West, 214.00 feet along the southerly line of said Lot 9 and the westerly prolongation thereof to an intersection with a line parallel with and 40 feet easterly of the centerline of Brookhurst Street; thence South 00 16' 10" East, 302 feet along the last mentioned parallel line to an intersection with a line parallel with and 30 feet northerly of the south line of the Southwest quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., said point of intersection being in the said City boundary, as established by the Orange -1- p.....-..-~ Avenue Annexation to said City; thence leaving the boundary established by said Broadway-La Palma Annexation South 880 58' 00" West, 70.00 feet along said Orange Avenue Annexation boundary to the northwest corner of said Orange Avenue Annex- ation, said northwest corner also being a point in the east line of the Brookhurst-Lincoln Annexation to said City; thence leaving said Orange Avenue Annexation boundary and following along a portion of said Brookhurst-Lincoln Annex- ation, the following courses and distances: North 00 16' 10" West, 10.00 feet to the northeast corner of said Brook- hurst'-Lincoln Annexation boundary; thence South 880 58' 00" West, 300.00 feet, South 00 07' 36" West, 106.00 feet to the northeast corner of the Lincoln-Monterey Annexation to said City; thence leaving the said Brookhurst-Lincoln Annexation boundary and following along a portion of the said Lincoln- Monterey Annexation boundary the following courses and distances: South 880 58' 00" West, 194.00 feet; South 00 07' 54" East, 278.00 feet; South 880 58' DO" West, 292.00 feet, North 00 07' 54" West, 384 feet, more or less, to an intersection with a line parallel with and 40 feet northerly bfthe south line of Section 7, Township 4 South, Range 10 West, S.B.B. & M., said point of intersection being a point in t_w existing City limit line of the City of Anaheim, as established by the aforementioned Broadway-La Palma Annex- ation; thence leaving the said Lincoln-Monterey City Annex- ation boundary and following along a portion of said City boundary, as established per said Broadway-La Palma Annexa- tion, the following courses and distances: North 880 58' 00" East, 156.00 feet; North 00 16' 20" West, 1,408.58 feet; North 890 36' 20" East, 330.00 feet; South 00 16' 20" East, 100.00 feet; North 890 36' 20" East, 300.33 feet; South 00 16' 10" East, 28.00 feet, more or less; South 890 39' 04" East, 705.00 feet to the point of beginning. BE IT FURTHER RESOLVED that the polls of said election shall be opened at 7:00 o'clock A.M. of the day of said election and shall remain open continuously from said time until i:OO o'clock P.M. of the same day when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. ,,,,,....-..... 3~ IT FURTHER RESOLVED that at said special election, the question whether said new territory shall be annexed to, incorporated in, and made a part of the City of Anaheim, and the property in said new territory be, after such annexation, subject to taxation equally with the property within the City of Anaheim, to pay its pro rata portion, based upon assessed valuation, of all the bonded indebtedness of said City of Anaheim outstanding on the lOeh day of August , 19 72 , or theretofore authorized, shalrlbe submitted to the electors residing in said new territory so proposed to be annexed to said City of Anaheim. That said new territory hereinbefore described shall be indicated and referred to by the name of Kathryn-Lindsay Annexa- tion upon the ballots to be used at said special election. That on said ballots in addition to any other matters required by law, there shall be printed substantially the following: -2- ..',........ MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP: NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL .) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the word "NO". All marks except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter's ballot mark a cross (+) with pen or pencil. MEASURE SUBMITTED TO VOTE OF VOTERS Shall Kathryn~crsay Annexation be annexed to the City of Anaheim, Calif. and the property in said Kathryn- YES Lindsay Annexation be, after such annex~tion, subject to taxation equally with the property within said City of Anaheim, to pay its pro rata portion, based upon assessed valuation, of all bonded indebtedness of said City of : N 0 Anaheim outstanding on August 10 , : 19~, or theretofore authorized? . _._- . A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition or measure. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. - BE IT FU~THER RESOLVED that the City Clerk of said City be and she is hereby authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. BE IT FU~THER RESOLVED that for the purpose of holding said election there shall be, and there is hereby, established, one election precinct designated as hereinafter stated. The polling place for said precinct shall be the place hereinafter designated and the persons hereinafter named, being competent and qualified electors and residents of said territory and of said election precinct, are hereby appointed officers of election and ti4ey shall hold said election and make return thereof in the manner provided by law. Kathryn-Lindsay Annexation voting precinct shall consist of all of said above described territory proposed to be annexed to the City of Anaheim for the purpose of holding said election. -3- Polling Place: MORRIS PREMISES, 8862 Bircher St. Orange County, California Inspector: MARJORIE M. AMMANN Except as otherwise provided in this resolution, said election hereby called shall be conducted as provided by law for municipal elections in the City of Anaheim and the Annexation Act of 1913. BE IT FURTHER RESOLVED that notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. BE IT FURTHER RESOLVED that except as otherwise provided, the ballots used, the opening and closing of the polls, and the conduct of the election in the territory shall conform as nearly as possible with the Elections Code provisions concerning general elections and the counting of votes, the canvassing of returns and the recording of votes shall be consistent with Sections 35131, 35132 and 35133 of the Government Code. AND BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded by registered mail to the executive officer of the Local Agency Formation Commission within five (5) days after a special election is called.
