RESOLUTION NO. 72R-259 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1309 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from ROY W. MABEE, owner, and JOSEPH E. BONADIMAN AND ASSOCIATES, agent, to establish a travel trailer park on C-l, GENERAL COW1ERCIAL zoned property described as follows: All that certain land s~tuated in the State of California, County of Orange, City of Anaheim, described as follows: That portion of the West half of the Southeast quarter of the Southeast quarter of Section 12, Township 4 South, Range 11 west, S.B.B. &. M., described as follows: Beginning at the Southeast corner of said West half, thence North 00 OS' 04" East 586.66 feet along the Easterly line of said West half, thence West parallel to the Southerly line of said West half, 190.46 feet, thence South 586.66 feet to a point in the Southerly line of said West half, said point being 189.60 feet West of the Southeast corner of said West half, thence East 189.60 feet along said Southerlv line of said West half to the point of beginning. Excepting therefrom the Southerly 40 feet. Also excepting therefrom "that portion conveyed to the Orange County Floor Control District by deed recorded Mav 10; 1960, in Book 5251, page 296 of Official Records. ~ AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City o~ Anaheim upon said application on May lS , 19 7? , notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the ~aheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. ~r 77_1o~Series , npnyi ng Conditioaal se Permit No. 130CJ and -1- - WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said conditional use permit and said appeal was set for public hearing on ~une 27 , 19 72 , at the City Hall, in the City of Anahe~m, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in denying said conditional use permit be, and the same is hereby disapproved , and that Conditional Use Permit No. 1309 be, and the same is hereby, granted permitting the establishment of a travel trailer park on C-l, GENERAL CO~ll1ERCIAL zoned property subject to the following conditions: 1. That street llghtlng facilities along Lincoln Avenue shall be installed as required by the Director of Public utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities and that a bond in an amoun-t and form satisfactory to the City of Anaheim shall be posted witt the City to guarantee the installation of the above.-:nen'cloned requirement. ^,""-, 2. That t;;e mmer of subject property shall pay to the Clty of Anaheim tLe sum of 15 cents per front foot along Lincoln Avenue for tree plantlng purposes. -2- $"-~ 3. That the sidewalks and driveways shall be relocated along Lincoln Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Depart- ment. 6. That a 6-foot masonry wall shall be constructed on the east property line adjacent to the R-A property. 7. That as-foot chainlink fence shall be constructed on the east property line adjacent to the Orange County Flood Control Channel in accordance with the standards of the Orange County Flood Control District. 8. That any parking area lighting proposed within 120 feet of the adjacent R-l Zone shall be down-lighting of a maximum height of 8 feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 9. That subject property shall be served by under- ground utilities. 10. That the proposed development shall be in accord- ance with the requirements of the State Trailer Act and that plumbing shall be provided in order that the mobilehome park will accommodate all trailers and not be restricted to "California approved trailers" only. 11. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 12. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 and 2. 13. That Conditions Nos. 1 and 2, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of 180 days, which- ever occurs first, or such further time as the City Council may grant. 14. That Conditions Nos. 3, 4, 5, 6, 7, 8, 9, 10 and 11, above mentioned, shall be complied with prior to final building and zoning inspections. ,/~ In addition to the above enumerated conditions, this Conditional Use Permit is granted subject to the elimination of proposed trailer space No. 15 as shown on the plans submitted and approved, to the construction of a eight (8) foot masonry wall along the northern boundary of the subject property and the installation of more intense landscaping plans and specifica- tions, which are to be submitted to the City Council for final approval prior to issuance of a building permit for the construc- tion of subject travel trailer park as stipulated and consented to by the applicant. -3- <,"-' The City Council reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner.. his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions therein.
