RESOLUTION NO. 72R- 258
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM COMPROMISING CERTAIN EMINENT DOMAIN
LITIGATION AND AUTHORIZING PAYMENT THEREFOR.
WHEREAS, heretofore, on the 29th day of September, 1971,
suit was filed in eminent domain to acquire certain right of way
in connection with the extension of Jackson Avenue easterly of
Park Vista Street, being entitled "City of Anaheim vs. J. Tardie,
Inc., etc., et al.," Orange County Superior Court Action No.
185,840; and
WHEREAS, in compromise thereof, the Defendants have
agreed to enter into a Stipulated Judgment in consideration of
receiving the sum of $13,680.00; and
WHEREAS, it is in the best interest of the City to
settle said Eminent Domain litigation as herein set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it direct and it does hereby authorize
and direct its City Attorney to enter into a Stipulated Judgment
in Eminent Domain to settle and conclude said Orange County Sup-
erior Court Action No. 185,840, entitled "City of Anaheim vs.
J. Tardie, Inc., etc., et al., II upon the terms and conditions
herein set forth.
BE IT FURTHER RESOLVED that the Finance Director be,
and he is hereby authorized and directed to draw a ~rrant in the
amount of $650.76 in favor of W.E. St John, County Clerk, to make
up the balance to be placed on deposit in compliance with said
Stipulated Judgment; that said warrant be delivered to the Office
of the City Attorney for transmittal upon the filing of said
Stipulated Judgment and Final Order of Condemnation, and that
the charge be allocated to Work Order No. 1237.
