72R-240 /- RESOLUTION NO. 72R-240 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 71-7~-47 to consider an amendment to Title 18 of the Anaheim Mun1cipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission the City Council did fix the 13th day of June 19 72, as the time, and the City Council Cham6erS in the City Harr-of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code,' and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. ,,~..-,,- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 71-72-47 ,~ All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: The East 108.00 feet of the West 447.00 feet of the Northeast quarter of the Northwest quarter of the South- west quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as per map recorded in Book 51, page 7 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPTING THEREFROM that portion included within the land conveyed to Michael Hein, by deed recorded April 12, 1919 in Book 331, page 243, Deeds, records of said Orange County, described as follows: Commencing at the Southeast corner of the North half of the Northwest quarter of the Southwest quarter of Section 14, Township 4 South, Range 11 West, Rancho Los Coyotes; thence North 16 rods; thence in a Southwesterly direction a distance of 25.61 rods, more or less, to a point in the South line of the North half of the Northwest quarter of the Southwest quarter of said Section 14, 20 rods West of the Southeast corner of said North half of the Northwest quarter of the Southwest quarter of said Section 14; thence East 20 rods to the point of beginning. ALSO EXCEPTING THEREFROM that portion thereof within Parcel Bl-515.01 and Parcel Bl-151.1 as described in that certain Final Order of Condemnation, Superior court, Case No. 88598, a certified copy of which was recorded May 1, 1962 in Book 6094, page 602 of Official Records of said Orange County. be excluded from the R-A, AGRICULTURAL ZONE and incorporated in the R-3, MULTIPLE-FN1ILY RESIDENTIAL ZONE, subject to the follow- ing conditions: 1. That street lighting facilities along Orange Avenue shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifica- tions on file 1n the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the instal- lation of the above-mentioned requirement. 2. That the owners of subject property shall pay to the City of Anaheim the sum of 15 cents per front foot along Orange Avenue for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. ,-............. 4. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Depart- ment. 5. Tllat a 6--foot masonry 1tlall shall be constructed along the east and west property lines and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of a 6-foot masonry wall along the west property line. -2- 6. That a 5-foot chainlink fence shall be constructed along the south property line adjacent to the Orange County Flood Control channel in accordance with the standard of the Orange County Flood Control District. 7. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 10. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 11. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1 and 2, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within 180 days from the date hereof or such further time as the City Council may grant. 12. That Conditions Nos. 3, 4, 5, 6,7, 8 and 10, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER P~SOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
