1950-1757and RESOLUTION NO. 1757 A RESOLUTION OF THE CITY OF .A LAHEIM AUTHORIZING THE PURCHASE OF CERTAIN PIPE TO BE USED IN THE CONSTRUCTION OF THE MAGNOLIA MAIN TRUNK LINE AND SEWERAGE SYSTEM AND AUTHORIZING THE CITY OF ANAHEIM TO ACT AS THE CONTRACTING AGENT FOR THE MEMBERS OF THE ORANGE COUNTY JOINT OUTFALL SEWER PARTICIPATING IN THE CON- STRUCTION OF SAID MAGNOLIA TRUNK SEWER, OUTFALL SEWERS AND SEWERAGE SYSTEM. WHEREAS, the members of the Orange County Joint Outfall Sewer are contemplating the construction of a trunk sewer line, out fall sewers and sewerage system known as the Magnolia Trunk Sewer, WHEREAS, it is contemplated that the construction of said Magnolia Trunk Sewer will be commenced during the latter part of 1950, and WHEREAS, several months' time will be required to manufac- ture the pipe necessary to be used in the construction of said Magnolia Line and that it is necessary that an order for the purchase of pipe be placed as soon as possible, and WHEREAS, the only concerns west of the City of St. Louis who manufacture the size and type of pipe that is required for the construction of the Magnolia Trunk Line, Outfall Sewers and Sewerage System are Gladding, McBean Co. of Lincoln, California and Pacific Clay Products Corp. of Los Nietos, California and that neither of said concerns can manufacture and furnish all of the pipe that will be required for the construction of said Magnolia Trunk Sewer, Out fall Sewers and Sewerage System but that both of said concerns to- gether can furnish sufficient pipe for said purpose. That the ship- ping and handling charges on said pipe from the city of St. Louis, Missouri, to Anaheim would add at least $5.00 per foot to the cost of said pipe, and WHEREAS, the City of Anaheim finds that Gladding, McBean Co. and Pacific Clay Products Corp. are the only concerns on the Pacific Coast who can furnish said pipe and that neither can furnish all of the pipe required but that both together can furnish the amount of pipe required and that there is no other concern in the United States located near enough to California to furnish said pipe at the price at which it can be manufactured and delivered by the two concerns above mentioned; that, therefore, it would be a useless and idle gesture to advertise for bids, and WHEREAS, the City of Anaheim finds that an order should be placed for the purchase of Four Thousand feet of such pipe at this time in order to have pipe ready to use in the construction of said Magnolia Trunk Sewer, Outfall Sewers and Sewer— age System when the members of the Joint Outfall Sewer are ready to commence the construction thereof and in order to avoid the delay that would be caused by the time required to manufacture said pipe; NOW, THEREFORE, BE IT RESOLVED by the City of Anaheim that an order for the purchase of Four Thousand Feet of pipe of the size and type required for said Magnolia Trunk Sewer, Outfall Sewers and Sewerage System be placed at this time with Gladding, McBean Co. and Pacific Clay Products Corp., and that the City of Anaheim be and it is hereby authorized to act as the contracting agent for the City of Anaheim and other members of Orange County Joint Outfall Sower participating in the construction of the Magnolia Trunk Sewer, Outfall Sewers, and Sewerage System and to place an order for the purchase of said pipe as herein directed, and BE IT FURTHER RESOLVED that the City of Anaheim hereby promises and agrees to pay its proportionate share of the cost of said pipe as such percentage is determined by the Resolution Authorizing the Construction of said Magnolia Trunk Sewer, Outfall Sewers and Expanded Outfall Sewerage System.
