A RESOLUTION OF THE CITY OF ANAHEIM
APPROVING THE ENGINEERS REPORT OF THE DESIGN OF TH1
PROPOSED MAGNOLIA TRUNK SEWER AND EXPANDED ORANGE COUNTY
JOINT OUTFALL SEWERAGE SYSTEM AND AUTHORIZING AND APPROV-
ING THE CONSTRUCTION OF THE MAGNOLIA TRUNK SEWER, OUTFALL
BY THE CITY OF OF ITS PROPORTIONATE
SEWERS, AND SEWER SYS M. AND AUTHORIZING THE PAYMENT
SHARE OF THE TOTAL COST OF THE CONSTRUCTION THEREOF, AND
AUTHORIZING THE CITY OF ANAHEIM TO ACT AS THE CONTRACTING
AGENT FOR THE MEMBERS OF THE ORANGE COUNTY JOINT OUTFALL
SEWER PARTICIPATING IN THE CONSTRUCTION OF SAID MAGNOLIA
TRUNK SEWER, OUTFALL SEWERS AND SEWERAGE SYSTEM.
WHEREAS, the members of the Orange .;cunty Joint Outfall Sewer
desire the construction of a trunk sewer line, outfall sewers, and
sewerage system known as the Mae Trunk Sewer, and
WHEREAS, the members ef the Joint Outfall Sewer Grcup did
heretofore authorize and cause engineering surveys to be made and an
engineering design, plans, costs, estiratee and capacity rights in
the Magnolia Trunk Line of the Joint Outfall Sewer to be made, com-
puted and determined, and
WFEREAS, the engineering repert and design has been examined
and approved by Koebig Koebig, consulting englneers, and it further
appearing that said engineering report and design is properly prepared
and adequate for the construction of said Magnolia Trunk Sewer, Out-
fall Sewers and Sewerage System and should be approved and the con-
struction thereof authcrized and that the City of Anaheim be authorized
to act as contractinw agent for the members of .the Orange County Joint
Outfall Sewer participating in the construction ef said Magnolia Trunk
Sewer, Outfall sewers and Sewerage System.
NOW, THEREFORE, BE IT RESOLVED by the City of12t,o...4L-1/
that the engineering report of 1949-1950 of the design of the proposed.
Magnolia Trunk Sewer and expanded Orange County Joint Outfall Sewerage
System be and the same is hereby approved and the construction thereof
is hereby approved and authorized; and
BE IT FURTHER RESOLVED that the City of Anaheim be and it is
hereby aut orized to act as contracting agent for the City of
and the other members of the Orange County Joint
Outfall Sewer participating In the construction of the Magnclia Trunk
Sewer, Outfall Sewers and expanded Joint Outfall Sewerage System and
is hereby authorized to advertise for bids, award contracts and to
take all steps legally necessary and required for the construction
and completion of said Magnolia Trunk Sewer, Outfall Sewers, and
expanded Joint Outfall Sewerage System; and
BE IT FURTHER RESOLVED that the City of
hereby promises and agrees to pay from funds now legally available or
from funds to be obtained from bonds issued and sold.2.2.41 per cent
of the total engineering, legal, construction and other costs of said
Magnolia Trunk Sewer, Outfall Sewers and Joint Outfall Sewerage System
and if funds are not presently available for the payment of its pro-
portionate cost of said project, to take all legal and necessary steps
and proceedings for the calling of an election to vote bonds to be
issued and sold to obtain the funds to pay its proportionate share of
the cost of said Magnolia Trunk Sewer, Outfall Sewers and Joint
Outfall Sewerage System; and
BE IT FURTHER RESOLVED that any offer hereafter made to sell
the sewer pipelines, sewerage system, equipment, and the facilities
for the maintenance and operation of the joint outfall sewer system
lying within Orange County Sanitation Districts 2 and 3 as they now
exist north of Ellis Avenue shall include the percentage of the total
cost of said Magnolia Trunk Sewer, Outfall Sewers and expanded Sewerage
System as above referred to that is paid by the City of

and such percentage of the total cost of any additional facilities
that is paid by the City of avt- shall, be and is hereby
added. to any price asked to effect a sale and transfer of title thereto
to any agency, district or group of contracting districts or agencies.
THE FOREGOING RESOLUTION is signed and approved by me this
