PECOLUTICN NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE EMPLOYMENT OF KCEBIG
AND KOEBIG, CONSULTING ENGINEERS, TO MAKE SURVEYS
AND PREPARE DETAILED DESIGNS, PLANS AND SPECIFI-
CATIONS, ESTIMATES OF QUANTITIES AND COSTS OF LABOR
AND MATERIALS FOR THE MAGNOLIA TRUNK LINE OF THE
JOINT OUTFALL SEWER AND TO RENDER OTHER SERVICES;
FIXING THEIR COMPENSATION AND AUTHORIZING THE CITY
CF ANAHEIM TO ACT AS THE CONTRACTING. AGENT FOR THE
OTHER MEMBERS OF THE JOINT OUTFALL SEWER GROUP AND
AUTHORIZING SAID CITY OF ANAHEIM TO ADVERTISE FOR
BIDS AND AWARD CONTRACTS FOR THE FURNISHING OF LABOR
AND MATERIALS FOR THE CONSTRUCTION OF SAID MAGNOLIA
TRUNK LINE.
WHEREAS, the members of the Orange County Joint Outfall
Sewer desire the construction of a trunk sewer known as the Magnolia
Trunk Seuer and which inciudes a pump plant and pressure main, and
WHEREAS, said members of the Orange County Joint Outfall
Sewer are desirous of making application to the federal Government
under Public Law 352, IS Congress, entitled "An At to Provide
for the Advance of Non-Fedcal Public Works" for funds for the
design of aaid Maznolia Trunk Sewer; and
W7EREAS aaid :7:embers of the Orange County Joint Outfall
Sewer desire to retain Koebig and Koebig, consulting engineers, to
furnish the folloving en inecring and other serces, owt; to
riake survey& and prepare detailed designs, plans and specifications,
estimates of quantities and costs of labor and materials fcr the
Magnolia Trunk Line of the Joint Outfall Sewer and to render other
services, at and for the compensation ereinafter stipulated and
to render assistance in procuring funds.

firm, cf consulting engineers be se employed and that the City of
Anaheim act as contrnoting agent for the mercer of the Orange
County joint Cutfall Sewer Group participatin g in. the construction
of said Magnolia Trunk Line and enter into a contract with said
Koebig and Koebig for the rendition of such services, and tbat the
said City of Anaheim as such ccntraotinc agent be and it is hereby
authorized to advertise for bids and award contracts for the furn-
ishing of labor and materials and for the construction of said
Magnolia Trunk Line in th.e manner provided by law; and
BE IT FURTHER. RESOLVED that said Koebig and Koebig be
paid compensation for aid services a. fee of four percent (4%) of
the tctal construetion cost of the Magnol-a Trunk Sewer Line in
accordance with the following sctedule:
(a) ,1.017 of the estimated construction cost, upon re-
ceipt of the initial payment for Advanee Planning from the Federal
Government.
(t) 3.25 of the estimated cost of the work, less pay-
ments previously made render Item (a) cf this paragraph, when the
City has received the final payment for advcnce Planning from the
Federal Government.
(c) L% of the construction cost, less payments made
under Items (a) and (b) of this paragraph in equal monthly install-
ments during the zo,rstruetion period
and
BE IT FURTHER RESOLVED that the City of Anaheim hereby
promises and agree s to pay its ercentag of the total cost of
such engineering service ftad .cnstruction of said Magnolia Trunk
Line of the Joint Cutfall Sever as aleeh percentage is set out in
the agreement and e tleretc f the joint construction of
additional facilities 17ade and entered into by and between the mem-
bers cf te Joint Outran Sewer Group; dnd
