1950-1745RESOLUTION NO. 1745 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING FILING OF APPLI- CATIO W TH THE UN TED STATES OF AMERICA FOR AN ADVANCE TO PROVIDE FOR THE ADVANCED PLANNING OF NON FEDERAL PUBLIC WORKS UNDER THE TERMS OF PUBLIC LAW 35 1$TjCONGGRESS OF THE UNITED STATES, APPROVED WHEREAS, the City Council of the City of Anaheim a municipal corporation, herein called the "Applicant after a thorough consideration of the various aspects of the problem and study of available data has hereby determined that the construction of oertain public works, generally described as main trunk and outfall sewers and sewage system is desirable and in the public interest and to that end it is necessary that action preliminary to the construction of said works be taken immediately; and WHEREAS, under the terms of Public Law 352, 81st Congress, approved October 13, 1949, the United States of America has author- ized the making of advances to public bodies to aid in defraying the cost of architectural engineering, and economic investigations and studies, surveys, designs, plans, working drawings, specifica- tions, procedures and other actions preliminary to the construction of public work (exclusive of housing) and WHEREAS, the Applicant has examined and duly considered such act and the Applicant considers it to be in the public interest and to its benefit to file an application under said act and to authorize other action in connection therewith: NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Anaheim the governing body of said Applicant as follows: 1. That the construction of said public works is essen- tial to and is to the best interests of the Applicant, and to the end that such public works may be provided as promptly as praet icabl it is desirable that action preliminary to the construction thereof 1 be undertaken immediately; 2 2. That the City of Anaheim as contracting agent be 3 and it is hereby authorized to file in behalf of the Applicant 4 and the other members of the Joint Outfall Sewer Group an appli- 5 cation (in form required by the United States and in conformity 6 with Public Law 352, 81st Congress, approved October 13, 1919) 7 for an advance of funds to be made by the United States to the 8 Applicant to aid in defraying the planning costs preliminary to 9 the construction of such public works which shall consist generally 10 of preparing surveys required by the detailed designs, plans,and 11 specifications, studies and estimates of quantities and costs of 12 labor and material and other costs for main trunk and outfall sewers 13 and sewage system; 14 3. That if such advance be made, the Applicant shall 15 provide or make necessary arrangements to provide such funds, in 16 addition to the advance, as may be required to defray the cost of 17 such action preliminary to the construction of the public works; 18 4. The said representative is hereby authorized to 19 furnish such information and take such other action as may be neces- 20 nary to enable the Applicant to qualify for the advance; 21 5. That the contracting agency designated in the pre 22 ceding paragraph is hereby designated as the authorized representa- 23 Live of the Applicant for the purposes of furnishing to the United 24 States such information, data and documents pertaining to the appli- 25 cation for an advance as may be required; and otherwise to act as the authorized representative of the Applicant in connection with 26 this application, 27 6.
