RESOLUTION OF THE CITY COUNCIL OF THE CITY OF Anaheim
AUTHORIZING AND DIRECTING SUCH LEGAL OR OTHER PROCEEDINGS
AS ARE LEGALLY NECESSARY TO ACQUIRE AND PERFECT TITLE TO
THE RIGHT OF WAY NOW USED BY THE LAND SECTION OF THE JOINT
OUTFALL SEWER GROUP IN SECTION 1 THEREOF, AND AUTHORIZING
THE EMPLOYMENT OF LEGAL COUNSEL TO INSTITUTE AND CONDUCT
SUCH PROCEEDINGS AND PROVIDE FOR THE DIVISION OF THE
EXPENSES AND COSTS THEREOF.
WHEREAS, the City Council of the City of Anaheim
1 finds that the condemnation proceedings instituted by the filing
l of that certain section in the Superior Court of the State of
ing agent for the Cities of Anaheim, Fullerton, Orange and Santa
Ana, be and it is hereby authorized and directed to obtain title
reports, institute legal or other proceedings, and do and perform
such other things as may be legally required to perfect and acquire
good title to the right of way now used by the land section of the
Joint Outfall Sewer Group in Section 1 thereof, and
BE IT FURTHER RESOLVED that said City of Santa Ana be and
it is hereby authorized and directed, as such contracting agent, to
employ Z. B. West and Preston Turner as legal counsel to institute,
prosecute and conduct all legal and other proceedings to acquire
and perfect the title to said right of way and that this City pay
one fourth of the fees, costs and expenses of such proceedings.

AND BE IT FURTHER RESOLVED that the said Z. B. West and
Preston Turner shall receive as compensation for said services the
sum of $75.00 per day each for the time actually devoted to the
performance of the duties and the rendition of services required
in perfecting and acquiring good title to the right of way now
used by the Land Section of the Joint Outfall Sewer in Section 1
thereof and actual and necessary expenses incurred in the perform-
ance of their duties and the rendition of such services plus their
mileage at the rate of ten cents (10¢ per mile; and
BE IT FURTHER RESOLVED that the Cities of Anaheim, Fuller-
ton, Orange and Santa Ana shall each pay one fourth of the fees
of such special counsel and their costs and expenses of said pro-
ceedings.
THE FOREGOING RESOLUTION is signed and approved by me
this 9th day of May 1950.
