WHEREAS, the sewage treatment plant in the County of Orange near Verano Street and Ellis Street is overloaded and the immediate construction of a new digester unit is necessary to properly handle the sewage and industrial waste from the Cities and Sanitary Districts which are parties signatory to certain agree- meats covering ownership, maim enance, construction, and operation; NOW, TIIEREP'ORE, BE IT RESOLVED; That the CITY OF SANTA ANA as Contract- ing City, is hereby authorized and directed to execute a contract with the en- gineering firm of Koebig and Boebig for the design of a digester unit at the fee of four percent (4~) of the construction cost of such unit. BLS' 1T FURTHER RESOLV}~D: That the CITY OB SANTA ANA, as contracting City is hereby authorized and directed to proceed as soon as the same may be done, to call for bids for the construction of a seventy five ('~5) foot digester unit at the site of the present treatment plant, to award the contract for such construc- tion to the lowest responsible bidder and to do all things necessary to exp®dite the construction of said digester unit which is hereby declared to be a necessary additional facility. BE IT BUHTHER RESOLVED: That the CITY OB ANAHEIM hereby promises and agrees to pay its percentage of the total coat of such additional facilities as such percentage is set out is the point agreement and supplements thereto for the ~ofnt constriction of additional facilities. BL iT FURTHER RESOLVED: That any offer heretofore made to sell the sewerage pipe--line and treatment plant is hereby modified to the extent that the percent of total cost of said digester unit above ref}rred to that is paid by the CITY OF ANAHEIM, any such percent of total cast a~ any other additional facility that is paid by CITY OF ANAHEIM shall be and is hereby added to the price asked to effect a sale and transfer of title to any agency or group of contracting districts. .PASSED AND ADOPTED by the City Council of the City of Anaheim at its regular meetiag held on the 14th a~.y of I'e'~ruary, i9~0.
