(2) That a variance is necessary for the preservation
and enjoyment of a substantial property right of said petitioners;
(3) That the granting of such conditional variance
will not be detrimental to the public welfare or injurious to the
property or improvements in the district wherein said property is
located, provided the conditions hereinafter set forth are complied
with:
RESOLUTION NO. /7/1
RESOLUTION GRANTING A VARIANCE
WHEREAS, B. B. Stakemiller, as owner, and B. W. Stake-
miller, as Lessee, of certain real property situated at 621 West
Center Street, in the City of Anaheim, County of Orange, State of
California, described as the south half of Lot 5, lock 5, Resh's
Subdivision, have filed with the City Planning Commission of the
City of Anaheim, a petition requesting that a variance be granted
permitting them to operate a Confectionery Store, including Candy,
Bakery Goods, Ice Cream, Hot and Cold Sandwiches; and
WHEREAS, the City Council finds from consideration and
investigation of the facts and the report and recommendation of the
City Plannin Commission that:
(1) Special circumstances and exceptional conditions
do exist as to the property or classes of uses in the same zone or
district;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ANAHEIM, that a conditional variance be, and the same
is hereby ranted to E. i. Stakemiller and. B. W. Stakemiller permit-
ting them to operate a Confectionery Store, including Candy, Bakery
Goods, Ice Cream, and Hot and. Cold Sandwiches upon the following
conditions:
1. That said uec'iness shall be operated in accordance
with all laws of the State of California and OrLineNces and Rer:ula-
tions of the City of Anarleim.

2. That the aooearance of said real property, includin,
all buildings thereon shall be lzent and maintained with a satisfacto y
appearance in kee with the uses herein oe=itted.

shall comply with all recuinements of the Chief of the Fire Depart-
ment of the City of Anaheim as to safety and fire prevention.
4. That only hot and cold sandwiches classified as
lunches be allowed.
5. That the City Council hereby reserves the rirht to
revoke said variance permit for good cause.
