1949-16651 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIY, CALIFORNIA, AUTHORIZ- ING SALE OF CERTAIN REAL PROPERTY AND AUTHORIZING THE EXECUTION OF A CONVEY- ANCE THEREOF AND RESCINDING RESOLUTION NO. 1653. WHEREAS, the City of Anaheim is the owner of the hereinafter described real property, and WHEREAS, said real property is no longer needed for municipal purposes, and WHEREAS, FORREST L. THEETGE and C. E. McGINIIS have made an offer to purchase said real property for the sum of Five Thousand Two Hundred ($5,200.00) Dollars, payable $1,000.00 forthwith, and the balance upon the close of escrow, and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interests of the City of Anaheim to accept said offer and sell and convey said real property to said Forrest L. Theetge and C. E. McGinnis upon the terms and conditions hereinafter specified: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL CF THE CITY OF ANAHEIM that the offer Forrest L. Theetge and C.E.McGinnis to purchase the hereinafter described real property for the sum of Five Thousand Two Hundred ($5,200.00) Dollars be accepted upon the following terms and conditions: 1. That the sum of $1,000.00 of the purchase trice be paid to the City Clerk forthwith; 2. That the balance of the purchase price, to-wit: $4,200.00 be placed in escrow at a reputable title company to be designated by the City Council of the City of Anaheim, to be paid to the City of j at the close of said escrow; 3. That the closing of said escrow be limited to a period of thirty days; provided. however, in the event said escrow is not closed within said period, of thirty days, the City of Anaheim RESOLUTION No ./4 6 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 shall have the right to elect to extend the time for the closing of said escrow or to cancel and terminate the same and, rescind said sale; 4. That if the purchasers shall fail to comply with the terms and conditions of said sale and the provisions of this resolution and of the escrow within said period of thirty days or such further period as said escrow may be extended, then they stall forfeit said sum of ,7$1,000.00, and shall forfeit all right to complete the purchase of said property or acquire any interest therein; 5. That said property shall be sold subject tolall conditions restrictions, reservations, easements and rights of way of record; 6. That said property is sold upon the condition that it is to be used for industrial purposes; 7. That said property is sold upon the condition that said Property will be improved in accordance with the plans and speci- fications submitted with and accompanying the application to purchase said. Property, and tat if the said purchasers shall fail to comply with this condition, then title to said Property shall revert to the City of Anaheim and the purchase price shall be returned to said purchaser, less the sum of 1,000.00 which shall be retained as a reasonable rental for said property. BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be and they are hereby authorized to execute a good and sufficient deed conveying to said Forrest L.Theetge and C. E. YoGinnis the following described real property situated in the City of Anaheim, County of Orange, State of California, and more particularly described as follows, to-wit: A tract of land in the City of Anaheim, County of Orange, State of California, including a portion of Lots 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, and 53, of the Schaffer-Oswald Subdivision, as shown on a map thereof filed -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 in book 7, page 41, Miscellaneous Maps, Records of Orange County, and also including a portion of that certain abandoned street formerly known as Julianne Street, lying between lots 37, 38, 39, 40, 41, 42, 43, 44 and said Lots 45, 46, 47, 48, 49, 50, 51, and 53 of said. Schaffer-Oswald Subdivision, said tract of land being more particularly described as follows: Beginning at a point on the north line of East La Palma Avenue, said point being 30 feet north of the monumented center line of said East La Palma Avenue and 406.87 feet east of the monumented center line of North Olive Street; thence North- wardly along a line parallel to the said monumented. center line of North Olive Street a distance of 405.00 feet to a point, said point being the true point of beginning; thence continuing Northwardly along a line parallel to said monumented center line of North Olive Street a distance of 165 feet to a point on the south line of Julianna Street as dedicated for public use by Resolution No. 1614, dated June 8th, 1948, thence East along the south line of said Julianna Street, said south line being Parallel to said north line of East La Palma Avenue a distance of 378.25 feet, more or less, to a point, said point being the Southwest Corner of Julianna Street and Pauline Street as dedicated by said Resolution No. 1614, said point also being 30 feet west of the East City Limit Line of the City of Anaheim; thence Southwardly along the Westerly line of said Pauline Street, said Westerly line being parallel to said East City Limit Line a distance of 165 feet to a point; thence West along a line parallel to the said north line of East La Palma Avenue a distance of 378.74 feet, more or less, to the true point of beginning, containing 1.44 acres, more or less. The above parcel subject to a 10-foot easement, running north and south, for utilities, the center line of which is 190 feet east and parallel with the westerly line of said parcel for overhead electric lines. -3- 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 The North Olive Street referred to in the above descript- ion is the Olive Street conveyed to the City of Anaheim by deed recorded February 1, 1926, in Book 625 of Deeds, oage 367, Orange County Records. SUBJECT to conditions, restrictions, reservations, easements and rights of way of record, and to deliver said deed into escrow to be delivered to said purchasers upon the completion of said escrow and the payment of the full purchase price as hereinabove provided. The City Clerk of the City of Anaheim is hereby directed to certify a copy of this Resolution and cause the same to be delivered to the County Recorder of Orange County, together with the deed herein referred to, and said recorder is hereby authorized to record said deed. BE IT FURTHER RESOLVED that Resolution No. 1653, rassed and adopted on the 25th day of January, 1949, be and the same is hereby rescinded.
