THE PURCHASE OF REAL PROPERTY AND ACCEPTING CONVEYANCE THEREOF WHEREAS, the City Council of the City of Anaheim finds it necessary to establish off-street parking areas as near as possib to Center and Los Angeles Streets in the City of Anaheim and find that the establishment and maintenance of such off-street parking areas are reasonably necessary and for the benefit and best interests of the City of Anaheim, and WHEREAS, Helen Johanne Miller and Grace Virginia Blackman are the owners of the property hereinafter described, and as such owners of such real property have offered to sell said real property to the City of Anaheim on the terms hereinafter stated, and that said real property is suitable and desirable for the establishment and maintenance of an off-street parking area, and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit end best interests of the City of Anaheim to accept said offer and purchase said real property on the terms and conditions hereinafter set forth, and WHER7AS, the City Council of the City of further finds that there will be sufficient funds derived from the "Parkin Meter Fund" to pay the purchase price for said real property, and that any obligation of the City of Anaheim for the purchase of said property will not and shall not become a charge against the City General Fund or the credit of the City of Anaheim, and that the owners of said land have agreed that the consideration for sal real property shall be paid solely from the "Parking Meter Fund"; NOV?, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that the real property hereinafter mentioned and des- cribed be purchased from Helen Johanne Miller and Grace Virginia Bladkrnan for the total sum of 10,000.00, payable as follows, to-wit: Two Thousand ($2,000.00) Dollars upon the execution and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 delivery to the City of Anaheim of a good and sufficient deed conveying said property to the City of Anaheim, together with a Policy of Title Insurance by a reputable title company of Orange County, California, showing said property vested in said Helen Johanne Miller and Grace Virginia Blackman, free and clear of all encumbrances except City and County taxes for the fiscal year 1948-49 and subject only to conditions, restrictions, easements, reservations and rights of way of record; and that the balance of said consideration shall be paid annually in installments of $2,000.00 or more, on tlie let day of September of each and every year, commencing September 1, 1949, and continuing until the balance of said consideration shall be paid in full, together with interest on the unpaid balance of said consideration at the rate of five per cent (5%) per annum, payable annually, on the 1st day of September of each year commencing September 1, 1949. BE IT FURTHER RESOLVED that the entire consideration for the purchase of said real property shall be paid solely from the speoial fund of the City of Anaheim designated as the "Parking Meter Fund" and that no part of the principal or interest shall be or become a charge against the City General Fund or general credit of the City of Anaheim but it shall be limited solely to payment from the "Parking Meter Fund". BE IT FURTHER RESOLVED that the said Helen Johanne Miller and GraceVirginia Blackman may reserve a vendorts lien upon said property as security for the unpaid portion of the purchase price. BE IT FURTHER RESOLVED that the City of Anaheim accept a conveyance of said property from said Helen Johanne Miller and Grace Virginia Blackman, upon the terms and conditions hereinabov set forth.
