WHEREAS, Dr. Erwrin H. Kersten, as owner of certain real
property situated at 951 North Palm Street, in the City of Anaheim,
County of Orange, State of California, described as the Southwest
Corner of Palm and La Palma Streets, 195 feet along Paim Street and
326 feet along La Palma, has filed with the City Planning Commissio
of the City of Anaheim, a petition requesting that a variance be
granted permitting the construction of a modern Medical Clinic on
said real property; and
WHEREAS, the City Council finds from consideration and
investigation of the facts and the report and recommendation of
the City Planning Commission that:
(1) Special circumstances and exceptional conditions do
exist as to the property or classes of uses in the same zone or
district;
(2) That a variance is necessary for the preservation and

RESOLUTION GRANTING A VARIANCE
substantial property right of said petitioner;
the granting of such conditional variance will not

in the district wherein said property is located,
provided the conditions hereinafter set forth are complied with:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that a conditional variance be, and the same is
hereby granted to Dr. Erwin H. Kersten for the construction of a
modern Medical Clinic at 951 North Paim Street at the Northeast
corner of Lot 40, Anaheim Extension, upon the following conditions:
1. That said proposed building be of modern steel reinforced
stone and concrete.
2. That said business shall be operated in accordance with
all laws of the State of California, and Ordinances and Regulations
of the City of Anaheim.

3. That the appearance of said real property, including all
buildings and improvements thereon shall be kept and maintained
with a satisfactory appearance in keeping with the uses herein
permitted.
4. That the maintenance and operation of said Medical Clinic
shall comply with all requirements of the Chief of the Fire Depart-
ment of the City of Anaheim as to safety and fire prevention.
5. That said modern Medical Clinic building be constructed
in accordance with the plans submitted with the application for
a variance, and that it comply with all city building ordinances
and regulations.
6. That the City Council hereby reserves the right to revoke
said variance permit for good cause.
THE FOREGOING RESOLUTION is signed and approved by me this
