A RESOLUTION CF THE CITY COUNCIL OF THE CITY OF AFAHEIL AUTHORIZING THE PURCHASE OF REAL PROPERTY OR THE ESTABLISH ,ENT CF CFF-STREET PARKING LOTS. 7HEREAS, the City Council of the City of Anaheim finds it necessary to establish off-street parking areas as near as possible to Center and Los Angeles Streets in the City of Anaheim and finds that the establishment and maintenance of such off-street parking areas are reasonably necessary and for the benefit and best interest of the City of Anaheim, and WHEREAS, Gilbert U. Kraemer and. Esther Kraemer, husband and wife, as joint tenants, are the owners of the property hereinafter described, and as such owners of such real property have offered to sell said real property to the City of Anaheim on the terms here- inafter stated, and that said real property is suitable and desir- able for the establishment End maintenance of an off-street parking area, and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and, best interests of the City of Anaheim to accept said offer and purchase said real property on the terms and conditions hereinafter set forth, and WHEREAS, the City Council of the City of Anaheim further finds that there will be sufficient funds derived from the "Parking Meter 7undu to pay the purchase price for said real property, and that any obligation of the City of Anaheim for the purchase of said property will not and shall not become a charge against the City General Fund or the credit of the City of Anaheim, and that the owners of said lard have agreed that the consideration for said real property shall be paid solely from the liParking Meter Fund"; THERFORE, EE IT RESCLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that the real property hereinafter mentioned and describe be purchased from Gilbert U. Kraemer and Esther Kraemer, husband and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 2 3 4 5 6 7 8 9 wife, as joint tenants, for the total sum of Eight Thousand (8,000. 0 Dollars, payable as follows; to-wit: Two Thousand (42,000.00) Dollars upon the execution and delivery to the City of Anaheim of a good and sufficient deed conveying said property to the City of Anaheim, together 1 a Policy of Title insurance by a reputable title company of Orange County, California, showing said property vested in said Gilbert U. Kraemer and Esther Kraemer, husband and wife, as joint tenants, free and clear of all incumbrances except City and County taxes for the fiscal year 1948-49 and subject only to conditions, restrictions, easements, reservations and rights-of- way of record, and that the balance of said consideration shall be paid annually in installments of Two Thousand k2,000.00) Dollars or more, on the lst day of July of each and every year, commencing July 1, 1949, and continuing until the balance of said considera- tion shall be paid in full, together with interest on the unpaid balance of said consideration at the rate of five per cent (5o) per annum, payable annually, on the lst day of July of each year, commencing July 1, 1949. AND BE IT FURTHER RESOLVED that the entire consideration for the purchase of said real property shall be paid solely from the special fund of the City of Anaheim designated as the "Parking eter Fund" and that no part of the principal nor interest shall be or become a charge against the City General Fund or general credit of the City of Anaheim but it shall be limited solely to payment from the "Parking peter Fund." AND BE IT FURTHER RESOLVED that the said Gilbert U. Kraemer and Esther Kraemer, husband and wife, as joint tenants, may reserve a vendor's lien upon said croperty as security for the unpaid portion of the purchase price. AND BE IT FURTHER RESOLVED that the City 'of Anaheim iminez, accept a. conveyance of said property from said Gilbert U. Said real property is situated in the City of Anaheim, County of Orange, and more particularly described as follows: The Westerly one-half of Lot 38, Original Town of Anaheim, as shown on a map recorded in Book 4, pages 629 and 630 of Deeds of Los Angeles County, excepting the Northerly nine feet thereof which has been conveyed to the City of Anaheim for alley purposes.
