Ward and Persia Ward, as Owners, of certain real property situated in the County of Orange, State of California, described as The West 150 feet of the South 120 feet of the South one -half (S-) of the Southwest quarter (SW) of the Northwest Quarter (NW4) of Section 12, Township 4 South, Range 10 West, S. B. B. M., excepting that portion lying within the Anaheim -Olive Boulevard, which is situated on the northeast corner of Anaheim -Olive Boulevard and Placentia Avenue, has filed with the City Planning Commission of the City of Anaheim a petition requesting that a variance be granted permitting the operation of the business of a service station on said real property; and WHEREAS, The City Council finds from consideration and investigation of the facts and the report and recommendations of the City Planning Commission that: (1). Special circumstances and exceptional conditions do exist as to the above described real property that do not apply generally to the property or classes of uses in the same zone or district. (2) That a variance is necessary for the preservation and enjoyment of a substantial property right of said petitioner. (3) That the granting of such conditional variance will not be detrimental to the public welfare or injurious to the prop- erty ar improvements in the district wherein said property is located, provided the conditions hereinafter set forth are complied with. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM, that a conditional variance be, and the same is hereby granted whereby a service station may be maintained and operated upon said real property upon the following conditions: 1. That said business shall be operated in accordance ii with all laws of the State of California and ordinances and regu- lations of the City of Anaheim. 2. That said station lay -out shall be substantially in accord ance with drawings P.L. 171 -B, and all structures shall be set back at least fifty feet from the center lines of both highways. 3. That the appearance of said real property including all buildings and improvements thereon shall be kept and maintained with a satisfactory appearance in keeping with the use herein per- mitted. 4. That the maintenance and operation of said business shall comply with all requirements of the Chief of the Fire Department of the City of Anaheim as to safety and fire prevention. 5. That the City Council hereby reserves the right to revoke said variance permit for good cause.
