72R-214 RESOLUTION NO. 72R- 214 """...- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 71R-466 IN RECLASSIFICATION PROCEEDINGS NO. 71-72-15. WHEREAS, the City Council did heretofore adopt its Resolution No. 71R-466 finding and determining that the property and area therein described should be changed from R-A, Residential- Agricultural Zone, to R-H 10,000, Residential Hillside Zone, subject to certain conditions set forth in said resolution; and WHEREAS, Condition No.3 of Resolution No. 71R-466 reads as follows: "3. That prior to the approval of a final tract map, the owner(s) of subject property Shall make an irrevocable offer to dedicate an easement for riding and hiking trail purposes over that portion of subject property over which the Four Corners Pipe Line Company has an easement for pipe line and incidental purposes on the date of this resolu- tion. Said offer to dedicate shall be irrevocable for a period of 20 years and may be accepted by the City of Anaheim at such time as it is determined that development of such facilities would be in the best interest of the City of Anaheim. Said irrevo- cable offer to dedicate shall include consent of the Four Corners Pipe Line Company for such easement. Said irrevocable offer to dedicate shall be recorded concurrently with the final tract map." AND WHEREAS, the City Council finds that said condition should be changed to read as follows: "3. That prior to the approval of a final tract map, the owner(s) of subject property shall make an irrevo- cable offer to dedicate an easement for riding and hiking trail purposes over that portion of subject property over which the Four Corners Pipe Line Company has an easement for pipe line and incidental purposes on the date of this resolution. Said offer to dedicate shall be irrevocable for a period of 20 years and may be accepted by the City of Anaheim at such time as it is determined that development of such facilities would be in the best interest of the City of Anaheim. Said irrevocable offer to dedicate shall be recorded concurrently with the final tract map. " NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Condition No. 3 of Resolution No. 7lR- 466 in Reclassification Proceedings No. 71-72-15 be and the same is hereby amended to read as follows: ,....;..c.'__ "3.
