72R-184 RESOLUTION NO. 72R-184 "- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2342. WHEREAS, after a request for variance by LILLIAN and OTT HAYES was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2342 was denied covering the following described property: Lot No. 197 of Tract No. 1202 as recorded in Book No. 37, page 28, Miscellaneous Maps in the Office of the County Recorder of Orange County. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the follow- ing findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown on (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, permitting the establishment of a real estate and notary office in conjunction with an existing single family home on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.38.050(4-a-l) Minimum number of parking stalls (5 required; 3 proposed) SECTION 18.62.060(a) ,r-'_ Signs permitted in the R-l Zone (1 sq. ft. of lighted sign permitted; 7-1/2 feet of lighted sign proposed) Permitted uses (real estate office proposed; real estate office not permitted) That said variance is granted subject to the following conditions and additional stipulations of applicant: SECTION 18.24.010 1. Applicant stipulates that the real estate business shall only be operated by one person, without additional employees, the sign limited to one-square foot, unlighted and the variance be limited to five years. -1- 2. That the sidewalks shall be installed along Siesta Street and Sequoia Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3. That the vehicular access rights except at the driveway location as shown on the submitted plan to Siesta Street and Sequoia Avenue shall be dedicated to the City of Anaheim. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 5. That a 6-foot masonry wall shall be constructed along the southerly property line. 6. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3 and 4. 7. That Condition No.3, above mentioned, shall be complied with prior to the commencement of the activity au~orized under this resolution, or prior to the time that the building permit is issued, or within a period of 180 days from the date hereof, whichever occurs first, or such further time as the City Council may grant. 8. That Conditions Nos. 2, 4, 5 and 6, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim Municipal Code unless otherwise specified herein.
