A RESOLUTION OF THE CITY COUNCIL OP THE CITY
OF ANAHEIM APPROVING THE TElU!S AND CONDITIONS
OF AN ENCROACHMEN'l' PE:RMI'l' ~D AU'fHO~IZ ING THE
~YOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMrr WITH MICHAEL J. AND WCILLE M.
SCHWARTZ. (71-7E)
WHEREAS, Michael J. Schwart~ and Lucille M. Schwartz
are the owners of property in the City of Anaheim over which
the City owns an easement for public utility purposes; and
WHEREAS, Michael J. and Lucille M. Schwartz wish to
use a portion of said easement for the purpose of constructing
a swiIuJaing pooli and
WHEREAS, unless Michael J. and Lucille M. Schwartz
are allowed to encroach upon the easement of the City, an extreme
and undue hardship will be caused to themi and
WHEREAS, the proposed encroachment to construct a
swimming pool across a portion of the easement of City will not
interfere with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a license
agreement between the City of Anaheim and Michael J. and Lucille M.
Schwartz be, and the same are hereby approved.
BE I'l' FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized to execute said license agreement on behalf
of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
