72R-170 .~ RESOLUTION NO. 72iR-170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DET~RMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED ANlD THAT THE BOUNDAR- IES OF CERTAIN ZONES SHOULD BE C~GED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 71-72-38 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 2nd day of May, 1972, and continued to the 9th day of May, 1972, as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recom- mendation; and .,.- WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 71-72-38 ~- Parcell: That portion of the North half of the Northwest quarter of the Southeast quarter of Section 8, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on map recorded in Book 51, page 10 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at the Northeast corner of said Northwest quarter of the Southeast quarter; thence South 00 08' 52" East along the Easterly line of said Northwest quarter of the Southeast quarter to the Northeasterly line of the land described in Certificate of Title No. 13252, to the State of California, filed January 10, 1950, in the Office of the Registrar of Titles of said County; thence North 560 45' 25" West 217.34 feet along said Northeasterly line to the most Southerly corner of the land described to Carl Peltzer, and wife filed October 15, 1954, as Torrons Document No. 30000, in the Office of said Registrar of Titles, thence along the Easterly boundary of said Peltzer's land the following bearings and distances: North 10 17' 57" West 102.85 feet, South 880 55' 52" East 54.56 feet, North P 17' 57" West 50.00 feet, South 880 5ei' 52" East 107.00 feet to a line parallel with and Westerly 23.00 feet from said Easterly line of the Northwest quarter of the Southeast quarter, North 0 o. 08' 52" West 313.72 feet along said parallel line to a point on the North line of said North- west quarter of the Southeast quarter distant thereon 23.00 feet from the poL~t of beginning; thence leaving the boundary of said Peltzer's land, South 89. 43' 3D" East 23.00 feet to the point of beginning. Parcel 2: That portion of the North half of the Northwest quarter of the Southeast quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., in the Rancho Los Coyotes, County of Orange, State of California, as said section is shown on a map recorded in Book 51, page 10, Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: ,~- Beginning at a point on the North line of said Northwest quarter of the Southeast quarter North 890 43' 3D" West 23.00 feet from the Northeast corner of said Northwest quarter of the Southeast quarter, thence North 890 43' 3D" West 736.73 feet to the Northeast corner of the land describe in Certificate No. 13252 to the State of California, in the Office of the Registrar of Titles, of said County; thence South, Southwesterly and Southeasterly along the Easterly lines of said land to the State of California to a point on said Easterly line North 560 45' 25" West 217.34 feet thereon from the East line of said Northwest quarter of the South- east quarter; thence North 10 17' 57" West 102.85 feet; thence South 880 56' 52" East 54.56 feet; thence North 10 17' 57" West 50.00 feet; thence South 880 56' 52" East 107 feet to a line parallel with and Westerly 23.00 feet from the East line of the Northwest quarter of the Southeast quarter of said Section; thence North 00 08' 52" West 313.72 feet along said East line to the point of beginning. Excepting from Parcels 1 and 2 that portion of the North half of the Northwest quarter of the Southeast quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., more particularly described in a deed by Urban Carl Peltzer and Zoe J. Peltzer to the State of California, recorded May 10, 1956, in Book 3504, page 171 of Official Records of Orange County. -2- be excluded from the R-A, AGRICULTURAL ZONE, and incorporated in the R-3, MULTIPLE FAMILY RESIDENTIAL ZONE, subject to the following conditions: i"-' 1. That all engineering requirements of the City of Anaheim along Crescent Avenue including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer; that street lighting facilities along Crescent Avenue shall be installed as required by the Director of Public utilities and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned require- ments. 2. That the owners of subject property shall pay to the City of Anaheim IS~ per front foot along Crescent Avenue for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 4. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 5. That a 6-foot masonry wall shall be constructed along the east, west and southwest propertly lines. 6. That subject property shall be served by underground utilities. 7. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 8. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 9. That the alignment of the southwesterly property line adjacent to the Santa Ana Freeway and the northerly property line adjacent to Crescent Avenue shall be approved by the California Division of Highways, and that the owner of subject property shall deed to the City of Anaheim the right of way and access rights required for the future Crescent Avenue overcrossing of the Santa Ana Freeway as has been determined necessary by the California Division of Highways. 10. That all air conditioning facilities shall be properly shielded from view. /- 11. That any parking area lighting proposed within 120 feet of any single-family residential development shall be down-lighting of a maximum height of 6 feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. -3- ,""-' 12. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4, 5 and 6. 13. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1 and 2, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within 180 days from the date hereof or such further time as the City Council may grant. 14. That Conditions Nos. 3, 4, 5, 6, 8, 9, 10, 11 and 12, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. this THE FOREGOING RESOLUTION is approved and signed by me 9th day of May , 19 72. .
