A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHED1 COMPROMISING CERTAIN EMINENT DOMAIN
LITIGATION; ACCEPTING A CERTAIN EASEMENT DEED;
AND AUTHORIZING AND DIRECTING PATI~NT THEREFOR.
WHEREAS, heretofore, on the 20th day of January, 1972,
suit was filed in eminent domain to acquire certain easement in
connection with the construction of an improvement for highway
and public utility purposes, being entitled "City of Anaheim vs.
Paul '1'. Schlue, et al.," Orange County Superior Court Action
No. 189304; and
WHEREAS, in compromise thereof, the City is in receipt
of an easement deed covering the permanent easement sought in
the aforementioned litigation and it is in the best interests of
the City of Anaheim to accept said easement deed for recordation;
and
~~REAS, the Defendant, Paul T. Schlue, has offered
to settle said litigation for the sum of $1,990, including all
severance and other damage; and
WHEREAS, the City Council finds that said sum is fair
and reasonable and that it would be in the best interests of the
City of Anaheim to accept such settlement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it accept, and it does hereby accept
the easement grant deed to the permanent easement sought in
Orange County Superior Court Action No. 189304, being entitled
"City of Anaheim vs. Paul T. Schlue, et al.," and that the City
Clerk be, and she is hereby directed to cause the said deed to
be recorded.
BE IT FURTHER RESOLVED that the City Council authorize
and direct, and it does hereby authorize and direct, the settle-
ment of said eminent domain litigation for the sum of $1,990.
BE IT FURTHER RESOLVED that the Finance Director be,
and he is hereby authorized and directed to draw a warrant in
the amount of $1,990 in favor of Paul T. Schlue and that said
warrant be delivered to the office of the City Attorney for
transmittal.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of __ -April , 1972.
