RESOLUTION NO. 72R-163

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY
AND THE ATCHISON, TOPEKA AND SANTA FE RAILWAY
COMPANY PROVIDING FOR THE EXTENSION OF KELLOGG
DRIVE ACROSS SAID RAILWAY COMPANY' STRACK
(MILE POST 39.2).
WHEREAS, the City of Anaheim proposes to construct
Kellogg Drive at grade across the right of way and tracks of
Santa Fe, having a roadway width of 64 feet between curbs, the
centerline thereof crossing said tracks at Mile Post 39.2,
Third District Main Line; and
WHEREAS, said Railway Company is willing that the
City extend said street across its right of way and tracks; and
WHEREAS, The Atchison, Topeka and Santa Fe Railway
Company has tendered to the City an agreement to be entered into
between the parties providing for the extension of said Kellogg
Drive, the terms and conditions of which the City Council finds
are satisfactory and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this date tendered to the
City Council by The Atchison, Topeka and Santa Fe Railway Company
to be made and entered into between the parties providing for
the construction of Kellogg Drive across the right of way and
track of Santa Fe be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of April, 1972.
