72R-141 ~~ RESOLUTION NO. 72R-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 71-72-33 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission the City Council did fix the 18th day of April , 19~, as the time, and the City Council Cham6erS in the City Harr-of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 71-72-33 That portion of Lot 45 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a Map of Survey by William Hamel, a copy of which is shown in Book 3, pages 162 to 164, inclusive, of "Los Angeles County Haps" in the Office of the County Recorder of Orange County, California, described as follows: Beginning at the northwest corner of the land described in the deed to Thomas J. Whieldon recorded June 15, 1950, in Book 2027, page 350 of Official Records said point being distant south 740 50' 20" west 447.00 feet from the South- east corner of said Lot 45, and on the north line of said Lot 45; thence south 150 06' 25" east along the westerly line of Whieldon to a line that is parallel with and northerly 115.00 feet from the south line of said Lot 45; thence southwesterly 146.53 feet along said parallel line; thence North 150 06' 25" West 35.00 feet to a line that is parallel with and northerly 150.00 feet from the southerly line of said Lot 457 thence southwesterly 325.00 feet along said parallel line to a line that is parallel with and southwesterly 471.53 feet from said westerly line of Whieldon; thence North 150 06' 25" West along said parallel line to the northerly line of said Lot 45; thence South- easterly along said Northerly line to the point of beginning. A portion of said land is shown on a Map filed in Book 19, page 32 of Record of Surveys in the Office of the County Recorder of said County. be excluded from R-l, ONE FAMILY RESIDENTIAL ZONE, and incorporated in R-3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the center- line of the street along La Palma Avenue for street widening purposes. 2. That street lighting facilities along La Palma Avenue and North Street shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities, and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 3. That the vehicular access rights to La Palma Avenue, including ingress and egress, along the northerly property line of subject property from the westerly end thereof to a point 75 feet from the easterly end thereof shall be dedicated to the City of Anaheim. 4. That the owners of subject property shall pay to the City of Anaheim the sum of l5~ per front foot along North Street for tree planting purposes. 5. That the sidewalks shall be installed along North Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. -2- ~-- H'.' .4 6. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 8. That a 6-foot masonry wall shall be constructed along the south and east property lines adjacent to R-l zoned property. 9. That subject property shall be served by underground utilities. 10. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 11. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 12. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1, 2, 3 and 4, above ~ntioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within 180 days from the date hereof or such further time as the City Council may grant. 13. That Conditions Nos. 5, 6, 7, 8, 9 and 11, above mentioned, shall be complied with prior to final building and zoning inspections.
